77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a study and report regarding optimal school district
1010 size and academic effectiveness.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. (a) The commissioner of education shall conduct
1313 a study regarding the optimal school district size to maximize
1414 functionality, ensure the efficient use of resources, and produce
1515 outstanding student and educational outcomes. In conducting the
1616 study, the commissioner shall consider the following factors:
1717 (1) school district organization and management;
1818 (2) the resources available to each school district;
1919 (3) the academic performance of students in each
2020 school district; and
2121 (4) student graduation rates for each school district.
2222 (b) The commissioner of education may seek assistance from
2323 relevant agencies and other interested parties in conducting the
2424 study under this section.
2525 (c) Not later than December 31, 2026, the commissioner of
2626 education shall submit to each legislative standing committee with
2727 primary jurisdiction over public education a report that includes:
2828 (1) the results of the study conducted under this
2929 section, including any determinations made with regard to an
3030 optimal school district size that would promote efficient operation
3131 and attainment of state educational goals; and
3232 (2) recommendations for legislative or other action.
3333 SECTION 2. This Act expires January 1, 2027.
3434 SECTION 3. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2025.
