88 AN ACT
99 relating to design and use of a model criminal citation.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 2B, Code of Criminal
1212 Procedure, is amended by adding Article 2B.0060 to read as follows:
1313 Art. 2B.0060. MODEL CITATION DESIGN. (a) In this article:
1414 (1) "Citation" means any summons, ticket, or other
1515 official document issued to a person by a peace officer that
1616 requires the person to respond or appear.
1717 (2) "Commission" means the Texas Commission on Law
1818 Enforcement.
1919 (3) "Law enforcement agency" means an agency of the
2020 state or an agency of a political subdivision of the state
2121 authorized by law to employ peace officers.
2222 (b) Not later than September 1 of each even-numbered year,
2323 each law enforcement agency shall adopt, implement, and, as
2424 necessary, amend the citation used by the agency. The citation
2525 implemented by the agency must conform to the model citation
2626 designed, adopted, and disseminated by the commission under this
2727 article.
2828 (c) The commission shall design, adopt, and disseminate to
2929 each law enforcement agency in this state a model citation for the
3030 purpose of:
3131 (1) reducing costs associated with the failure of a
3232 person issued a citation to appear for a scheduled court
3333 appearance; and
3434 (2) improving the efficiency of courts in this state.
3535 (d) The model citation adopted by the commission must:
3636 (1) be based on credible field, academic, or
3737 laboratory research;
3838 (2) include important information at the top of the
3939 citation, including the following in at least 18-point font:
4040 (A) the phone number of the person at the court
4141 who is able to provide additional information to or answer
4242 questions from the person issued a citation; and
4343 (B) the statement: "CALL THIS NUMBER FOR
4444 INFORMATION ABOUT THIS CITATION";
4545 (3) be written in clear, plain language and include,
4646 as applicable:
4747 (A) the date, time, and location at which a
4848 person issued a citation must appear for court;
4949 (B) the offense charged and the action the person
5050 issued a citation is required to take regarding the charge;
5151 (C) the consequences of missing a scheduled court
5252 appearance;
5353 (D) information regarding what the person issued
5454 a citation may expect at court, including an assurance that the
5555 person will not be arrested for an unresolved misdemeanor
5656 punishable by fine only;
5757 (E) details for any available resources to assist
5858 with a court appearance, including resources that provide text
5959 reminders, parking details, general directions to the court,
6060 transportation options, child-care assistance, and rescheduling
6161 instructions; and
6262 (F) details for persons who are unable to afford
6363 fines or costs imposed by a court, including details for a payment
6464 plan, payment deferral, community service, and waiver or reduction
6565 of the fines or costs; and
6666 (4) include any other information, procedure, or best
6767 practice that is supported by credible research or commonly
6868 accepted as a means to achieve the purposes described by Subsection
6969 (c).
7070 (e) The commission shall consult with the following in
7171 designing the model citation:
7272 (1) the Bill Blackwood Law Enforcement Management
7373 Institute of Texas located at Sam Houston State University;
7474 (2) small, medium, and large law enforcement agencies;
7575 (3) court clerks;
7676 (4) the Office of Court Administration of the Texas
7777 Judicial System;
7878 (5) judges;
7979 (6) public defenders; and
8080 (7) prosecutors.
8181 (f) The commission shall provide for a period of public
8282 comment before adopting the model citation design.
8383 (g) Not later than December 31 of each odd-numbered year,
8484 the commission shall:
8585 (1) review the model citation adopted under this
8686 article;
8787 (2) if appropriate, modify or update the design; and
8888 (3) disseminate the design to each law enforcement
8989 agency in this state.
9090 SECTION 2. (a) Not later than December 31, 2025, the Texas
9191 Commission on Law Enforcement shall design, adopt, and disseminate
9292 the model citation required under Article 2B.0060, Code of Criminal
9393 Procedure, as added by this Act.
9494 (b) Not later than September 1, 2026, each law enforcement
9595 agency to which Article 2B.0060, Code of Criminal Procedure, as
9696 added by this Act, applies shall adopt a citation as required by
9797 that article.
9898 SECTION 3. This Act takes effect September 1, 2025.
