77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to voting by a voter unable to enter a polling place.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 64.009(a), Election Code, is amended to
1212 read as follows:
1313 (a) On [If a voter is physically unable to enter the polling
1414 place without personal assistance or likelihood of injuring the
1515 voter's health, on] the voter's request, an election officer shall
1616 deliver a ballot to the voter at the polling place entrance or curb
1717 if the voter:
1818 (1) is physically unable to enter the polling place
1919 without personal assistance or likelihood of injuring the voter's
2020 health;
2121 (2) has legal custody of a child younger than 12 years
2222 of age and entering the polling place would require leaving the
2323 child without adequate supervision; or
2424 (3) is the primary caretaker of a person who is unable
2525 to care for themselves and entering the polling place would require
2626 leaving the person without adequate supervision.
2727 SECTION 2. This Act takes effect September 1, 2025.
