10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Section 64.009(a), Election Code, is amended to | |
12 | 12 | read as follows: | |
13 | 13 | (a) On [If a voter is physically unable to enter the polling | |
14 | 14 | place without personal assistance or likelihood of injuring the | |
15 | 15 | voter's health, on] the voter's request, an election officer shall | |
16 | 16 | deliver a ballot to the voter at the polling place entrance or curb | |
17 | 17 | if the voter: | |
18 | 18 | (1) is physically unable to enter the polling place | |
19 | 19 | without personal assistance or likelihood of injuring the voter's | |
20 | 20 | health; | |
21 | 21 | (2) has legal custody of a child younger than 12 years | |
22 | 22 | of age and entering the polling place would require leaving the | |
23 | 23 | child without adequate supervision; or | |
24 | 24 | (3) is the primary caretaker of a person who is unable | |
25 | 25 | to care for themselves and entering the polling place would require | |
26 | 26 | leaving the person without adequate supervision. | |
27 | 27 | SECTION 2. This Act takes effect September 1, 2025. |
