88 AN ACT
99 relating to creating a cause of action for nonconsensual condom
1010 removal or alteration.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Title 4, Civil Practice and Remedies Code, is
1313 amended by adding Chapter 98C to read as follows:
1414 CHAPTER 98C. LIABILITY FOR NONCONSENSUAL REMOVAL OR ALTERATION OF
1515 CONDOM DURING SEXUAL CONTACT
1616 Sec. 98C.001. DEFINITIONS. In this chapter:
1717 (1) "Consent" has the meaning assigned by Section
1818 1.07, Penal Code.
1919 (2) "Sexual contact" means contact between the anus or
2020 sexual organ of an individual and the anus or sexual organ of
2121 another.
2222 Sec. 98C.002. LIABILITY FOR NONCONSENSUAL REMOVAL OR
2323 ALTERATION OF CONDOM DURING SEXUAL CONTACT. A defendant is liable
2424 to an individual if the defendant, after intentionally removing,
2525 altering, or otherwise rendering a condom less effective than
2626 manufactured without the individual's consent, engages in sexual
2727 contact with the individual without a condom if removed or using the
2828 altered or less effective condom.
2929 Sec. 98C.003. DAMAGES. (a) A court shall award a claimant
3030 who prevails in an action brought under this chapter:
3131 (1) actual damages, including damages for mental
3232 anguish;
3333 (2) court costs; and
3434 (3) reasonable attorney's fees.
3535 (b) In addition to an award under Subsection (a), a claimant
3636 who prevails in an action brought under this chapter may recover
3737 exemplary damages.
3838 SECTION 2. The change in law made by this Act applies only
3939 to a cause of action that accrues on or after the effective date of
4040 this Act.
4141 SECTION 3. This Act takes effect September 1, 2025.
