| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 47.01(8), Penal Code, is amended to read |
|---|
| 13 | 13 | | as follows: |
|---|
| 14 | 14 | | (8) "Private place" means a place to which the public |
|---|
| 15 | 15 | | does not have access, and excludes, among other places, streets, |
|---|
| 16 | 16 | | highways, restaurants, taverns, nightclubs, commercial gaming |
|---|
| 17 | 17 | | enterprises, schools, hospitals, and the common areas of apartment |
|---|
| 18 | 18 | | houses, hotels, motels, office buildings, transportation |
|---|
| 19 | 19 | | facilities, and shops. For purposes of this subdivision, |
|---|
| 20 | 20 | | "commercial gaming enterprise" includes a for-profit poker club, |
|---|
| 21 | 21 | | card club, or game room. |
|---|
| 22 | 22 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 23 | 23 | | an offense committed on or after the effective date of this Act. An |
|---|
| 24 | 24 | | offense committed before the effective date of this Act is governed |
|---|
| 25 | 25 | | by the law in effect on the date the offense was committed, and the |
|---|
| 26 | 26 | | former law is continued in effect for that purpose. For purposes of |
|---|
| 27 | 27 | | this section, an offense was committed before the effective date of |
|---|
| 28 | 28 | | this Act if any element of the offense occurred before that date. |
|---|
| 29 | 29 | | SECTION 3. This Act takes effect September 1, 2025. |
