77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the licensing of a psychologist as a licensed
1010 specialist in school psychology; authorizing a fee.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 501.260, Occupations Code, is amended by
1313 amending Subsection (b) and adding Subsections (b-1) and (d) to
1414 read as follows:
1515 (b) The executive council shall set the standards to qualify
1616 for a license under this section. Except as provided by Subsection
1717 (b-1), [The] standards must include:
1818 (1) satisfaction of minimum recognized graduate
1919 degree requirements;
2020 (2) completion of graduate course work at a regionally
2121 accredited institution of higher education in:
2222 (A) psychological foundations;
2323 (B) educational foundations;
2424 (C) interventions;
2525 (D) assessments; and
2626 (E) professional issues and ethics;
2727 (3) completion of at least 1,200 hours of supervised
2828 experience;
2929 (4) receipt of a passing score on a nationally
3030 recognized qualifying examination determined to be appropriate by
3131 the executive council and on any other examination required by the
3232 executive council; and
3333 (5) satisfaction of the requirements under Sections
3434 501.2525(a)(3)-(9).
3535 (b-1) The executive council by rule shall provide for the
3636 issuance of a license under this section to a person who:
3737 (1) is licensed as a psychologist under this chapter;
3838 (2) has received a passing score on a nationally
3939 recognized qualifying examination determined to be appropriate by
4040 the executive council and on any other examination required by the
4141 executive council;
4242 (3) applies for the license in the manner prescribed
4343 by the executive council; and
4444 (4) pays the fee set by the executive council.
4545 (d) The executive council by rule may establish continuing
4646 education requirements for a psychologist who holds a license
4747 issued under this section in accordance with Subsection (b-1),
4848 including continuing education coursework in an amount and
4949 frequency established by the executive council that is related to:
5050 (1) the Individuals with Disabilities Education Act
5151 (20 U.S.C. Section 1400 et seq.);
5252 (2) Section 504, Rehabilitation Act of 1973 (29 U.S.C.
5353 Section 794);
5454 (3) special education evaluations; and
5555 (4) school-based psychological services.
5656 SECTION 2. The Texas Behavioral Health Executive Council
5757 shall adopt rules and fees necessary to implement Sections
5858 501.260(b-1) and (d), Occupations Code, as added by this Act, not
5959 later than January 1, 2026.
6060 SECTION 3. This Act takes effect September 1, 2025.
