88 AN ACT
99 relating to the capacity of a minor to consent to certain treatment
1010 for the minor or the minor's child.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The heading to Chapter 32, Family Code, is
1313 amended to read as follows:
1414 CHAPTER 32. CONSENT TO CERTAIN TREATMENT, CARE, AND SERVICES FOR
1515 [OF] CHILD BY NON-PARENT, MINOR PARENT, OR CHILD
1616 SECTION 2. Section 32.003(a), Family Code, is amended to
1717 read as follows:
1818 (a) A child may consent to medical, dental, psychological,
1919 and surgical treatment for the child by a licensed physician or
2020 dentist if the child:
2121 (1) is on active duty with the armed services of the
2222 United States of America;
2323 (2) is:
2424 (A) 16 years of age or older and resides separate
2525 and apart from the child's parents, managing conservator, or
2626 guardian, with or without the consent of the parents, managing
2727 conservator, or guardian and regardless of the duration of the
2828 residence; and
2929 (B) managing the child's own financial affairs,
3030 regardless of the source of the income;
3131 (3) consents to the diagnosis and treatment of an
3232 infectious, contagious, or communicable disease that is required by
3333 law or a rule to be reported by the licensed physician or dentist to
3434 a local health officer or the Texas Department of Health, including
3535 all diseases within the scope of Section 81.041, Health and Safety
3636 Code;
3737 (4) is unmarried and pregnant and consents to
3838 hospital, medical, or surgical treatment, other than abortion,
3939 related to the pregnancy;
4040 (5) consents to examination and treatment for drug or
4141 chemical addiction, drug or chemical dependency, or any other
4242 condition directly related to drug or chemical use;
4343 (6) is unmarried, is the parent of a child, and has
4444 actual custody of that [his or her] child [and consents to medical,
4545 dental, psychological, or surgical treatment for the child]; or
4646 (7) is serving a term of confinement in a facility
4747 operated by or under contract with the Texas Department of Criminal
4848 Justice, unless the treatment would constitute a prohibited
4949 practice under Section 164.052(a)(19), Occupations Code.
5050 SECTION 3. Subchapter A, Chapter 32, Family Code, is
5151 amended by adding Section 32.0031 to read as follows:
5252 Sec. 32.0031. CONSENT TO TREATMENT OF CHILD BY MINOR
5353 PARENT. A minor who is the parent of a child may consent to medical,
5454 dental, psychological, and surgical treatment for the child by a
5555 licensed physician or dentist if the minor:
5656 (1) is unmarried; and
5757 (2) has actual custody of the child.
5858 SECTION 4. This Act takes effect September 1, 2025.
