11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. The heading to Chapter 32, Family Code, is |
---|
13 | 13 | | amended to read as follows: |
---|
14 | 14 | | CHAPTER 32. CONSENT TO CERTAIN TREATMENT, CARE, AND SERVICES FOR |
---|
15 | 15 | | [OF] CHILD BY NON-PARENT, MINOR PARENT, OR CHILD |
---|
16 | 16 | | SECTION 2. Section 32.003(a), Family Code, is amended to |
---|
17 | 17 | | read as follows: |
---|
18 | 18 | | (a) A child may consent to medical, dental, psychological, |
---|
19 | 19 | | and surgical treatment for the child by a licensed physician or |
---|
20 | 20 | | dentist if the child: |
---|
21 | 21 | | (1) is on active duty with the armed services of the |
---|
22 | 22 | | United States of America; |
---|
23 | 23 | | (2) is: |
---|
24 | 24 | | (A) 16 years of age or older and resides separate |
---|
25 | 25 | | and apart from the child's parents, managing conservator, or |
---|
26 | 26 | | guardian, with or without the consent of the parents, managing |
---|
27 | 27 | | conservator, or guardian and regardless of the duration of the |
---|
28 | 28 | | residence; and |
---|
29 | 29 | | (B) managing the child's own financial affairs, |
---|
30 | 30 | | regardless of the source of the income; |
---|
31 | 31 | | (3) consents to the diagnosis and treatment of an |
---|
32 | 32 | | infectious, contagious, or communicable disease that is required by |
---|
33 | 33 | | law or a rule to be reported by the licensed physician or dentist to |
---|
34 | 34 | | a local health officer or the Texas Department of Health, including |
---|
35 | 35 | | all diseases within the scope of Section 81.041, Health and Safety |
---|
36 | 36 | | Code; |
---|
37 | 37 | | (4) is unmarried and pregnant and consents to |
---|
38 | 38 | | hospital, medical, or surgical treatment, other than abortion, |
---|
39 | 39 | | related to the pregnancy; |
---|
40 | 40 | | (5) consents to examination and treatment for drug or |
---|
41 | 41 | | chemical addiction, drug or chemical dependency, or any other |
---|
42 | 42 | | condition directly related to drug or chemical use; |
---|
43 | 43 | | (6) is unmarried, is the parent of a child, and has |
---|
44 | 44 | | actual custody of that [his or her] child [and consents to medical, |
---|
45 | 45 | | dental, psychological, or surgical treatment for the child]; or |
---|
46 | 46 | | (7) is serving a term of confinement in a facility |
---|
47 | 47 | | operated by or under contract with the Texas Department of Criminal |
---|
48 | 48 | | Justice, unless the treatment would constitute a prohibited |
---|
49 | 49 | | practice under Section 164.052(a)(19), Occupations Code. |
---|
50 | 50 | | SECTION 3. Subchapter A, Chapter 32, Family Code, is |
---|
51 | 51 | | amended by adding Section 32.0031 to read as follows: |
---|
52 | 52 | | Sec. 32.0031. CONSENT TO TREATMENT OF CHILD BY MINOR |
---|
53 | 53 | | PARENT. A minor who is the parent of a child may consent to medical, |
---|
54 | 54 | | dental, psychological, and surgical treatment for the child by a |
---|
55 | 55 | | licensed physician or dentist if the minor: |
---|
56 | 56 | | (1) is unmarried; and |
---|
57 | 57 | | (2) has actual custody of the child. |
---|
58 | 58 | | SECTION 4. This Act takes effect September 1, 2025. |
