88 AN ACT
99 relating to benefits paid by the Teacher Retirement System of
1010 Texas.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter H, Chapter 824, Government Code, is
1313 amended by adding Sections 824.7015 and 824.704 to read as follows:
1414 Sec. 824.7015. ONE-TIME ADJUSTMENT TO BENEFITS. (a)
1515 Notwithstanding any other provision of this subchapter, the amount
1616 of a monthly service retirement benefit, disability retirement
1717 benefit, or death benefit paid under this chapter is increased to
1818 include a one-time 10 percent adjustment in accordance with this
1919 section.
2020 (b) The board of trustees shall recompute the amount of a
2121 benefit paid monthly under this chapter by applying the 10 percent
2222 adjustment to the monthly amount otherwise required to be paid as
2323 determined in accordance with the other applicable provisions of
2424 this chapter and other law.
2525 Sec. 824.704. ANNUAL ADJUSTMENT FOR COST OF LIVING. (a)
2626 Notwithstanding any other provision of this subchapter, the amount
2727 of a monthly service retirement benefit, disability retirement
2828 benefit, or death benefit paid under this chapter is increased to
2929 include a four percent annual cost-of-living adjustment in
3030 accordance with this section.
3131 (b) On January 1 of each year, the board of trustees shall
3232 recompute the amount of a benefit paid monthly under this chapter by
3333 applying the four percent adjustment to the monthly amount
3434 otherwise required to be paid as determined in accordance with the
3535 other applicable provisions of this chapter and other law.
3636 SECTION 2. (a) The Teacher Retirement System of Texas
3737 shall make a supplemental payment of a retirement or death benefit,
3838 as provided by this section.
3939 (b) The supplemental payment is payable in January 2026 and,
4040 to the extent practicable, on a date or dates that coincide with the
4141 regular annuity payment payable to each eligible annuitant.
4242 (c) The amount of the supplemental payment is equal to the
4343 greater of:
4444 (1) $2,000; or
4545 (2) the gross amount of the regular annuity payment to
4646 which the eligible annuitant is otherwise entitled for the month of
4747 December 2025.
4848 (d) The supplemental payment is payable without regard to
4949 any forfeiture of benefits under Section 824.601, Government Code.
5050 The Teacher Retirement System of Texas shall make applicable tax
5151 withholding and other legally required deductions before
5252 disbursing the supplemental payment. A supplemental payment under
5353 this section is in addition to and not in lieu of the regular
5454 monthly annuity payment to which the eligible annuitant is
5555 otherwise entitled.
5656 (e) Subject to Subsection (f) of this section, to be
5757 eligible for the supplemental payment, a person must be, for the
5858 month of December 2025, and disregarding any forfeiture of benefits
5959 under Section 824.601, Government Code, an annuitant eligible to
6060 receive:
6161 (1) a standard retirement annuity payment;
6262 (2) an optional retirement annuity payment as either a
6363 retiree or beneficiary;
6464 (3) a life annuity payment under Section
6565 824.402(a)(4), Government Code;
6666 (4) an annuity for a guaranteed period of 60 months
6767 under Section 824.402(a)(3), Government Code; or
6868 (5) an alternate payee annuity payment under Section
6969 804.005, Government Code.
7070 (f) If the annuitant is a retiree or a beneficiary under an
7171 optional retirement payment plan, to be eligible for the
7272 supplemental payment, the effective date of the retirement of the
7373 member of the Teacher Retirement System of Texas must have been
7474 before September 1, 2024. If the annuitant is a beneficiary under
7575 Section 824.402(a)(3) or (4), Government Code, to be eligible for
7676 the supplemental payment, the date of death of the member of the
7777 retirement system must have been before September 1, 2024. The
7878 supplemental payment shall be made to an alternate payee who is an
7979 annuitant under Section 804.005, Government Code, only if the
8080 annuity payment to the alternate payee commenced before September
8181 1, 2024. The supplemental payment is in addition to the guaranteed
8282 number of payments under Section 824.402(a)(3) or 824.204(c)(3) or
8383 (4), Government Code, and may not be counted as one of the
8484 guaranteed monthly payments.
8585 (g) The supplemental payment does not apply to payments
8686 under:
8787 (1) Section 824.304(a), Government Code, relating to
8888 disability retirees with less than 10 years of service credit;
8989 (2) Section 824.304(b)(2), Government Code, relating
9090 to disability retirees who receive a disability annuity in an
9191 amount fixed by statute;
9292 (3) Section 824.804(b), Government Code, relating to
9393 participants in the deferred retirement option plan with regard to
9494 payments from their deferred retirement option plan accounts;
9595 (4) Section 824.501(a), Government Code, relating to
9696 retiree survivor beneficiaries who receive a survivor annuity in an
9797 amount fixed by statute; or
9898 (5) Section 824.404(a), Government Code, relating to
9999 active member survivor beneficiaries who receive a survivor annuity
100100 in an amount fixed by statute.
101101 (h) Except as provided by this section, the board of
102102 trustees of the Teacher Retirement System of Texas shall determine
103103 the eligibility for and the amount and timing of a supplemental
104104 payment and the manner in which the payment is made.
105105 (i) The Teacher Retirement System of Texas shall pay the
106106 supplemental payment made under this section from the retired
107107 reserve account and may transfer to that account from the state
108108 contribution account any portion of the amount that exceeds the
109109 amount in the retired reserve account available to finance the
110110 supplemental payment and that is actuarially determined to be
111111 necessary to finance the supplemental payment. The supplemental
112112 payment under this section must comply with Section 821.006,
113113 Government Code.
114114 SECTION 3. Sections 824.7015 and 824.704, Government Code,
115115 as added by this Act, apply only to a monthly benefit payment made
116116 by the Teacher Retirement System of Texas on or after September 1,
117117 2025.
118118 SECTION 4. This Act takes effect September 1, 2025.
