9 | 9 | | relating to required motor vehicle emissions inspections in certain |
---|
10 | 10 | | border counties. |
---|
11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 382.202(c), Health and Safety Code, is |
---|
13 | 13 | | amended to read as follows: |
---|
14 | 14 | | (c) If the program is established under this section, the |
---|
15 | 15 | | commission: |
---|
16 | 16 | | (1) shall adopt vehicle emissions inspection and |
---|
17 | 17 | | maintenance requirements for certain areas as required by federal |
---|
18 | 18 | | law or regulation; [and] |
---|
19 | 19 | | (2) shall adopt vehicle emissions inspection and |
---|
20 | 20 | | maintenance requirements for counties not subject to a specific |
---|
21 | 21 | | federal requirement in response to a formal request by resolutions |
---|
22 | 22 | | adopted by the county and the most populous municipality within the |
---|
23 | 23 | | county according to the most recent federal decennial census; and |
---|
24 | 24 | | (3) shall adopt vehicle emissions inspection and |
---|
25 | 25 | | maintenance requirements for counties not described by Subdivision |
---|
26 | 26 | | (1) or (2) that: |
---|
27 | 27 | | (A) border the United Mexican States; and |
---|
28 | 28 | | (B) contain an overweight corridor, as defined by |
---|
29 | 29 | | Section 548.301, Transportation Code. |
---|
30 | 30 | | SECTION 2. Section 548.301, Transportation Code, is amended |
---|
31 | 31 | | by adding Subsections (a-1) and (a-2) to read as follows: |
---|
32 | 32 | | (a-1) The commission by rule shall establish a motor vehicle |
---|
33 | 33 | | emissions inspection and maintenance program for vehicles located |
---|
34 | 34 | | in a county that: |
---|
35 | 35 | | (1) borders the United Mexican States; and |
---|
36 | 36 | | (2) contains an overweight corridor. |
---|
37 | 37 | | (a-2) For purposes of Subsection (a-1), "overweight |
---|
38 | 38 | | corridor" means a designated section of a state highway for which an |
---|
39 | 39 | | optional procedure is authorized under Chapter 623 for the issuance |
---|
40 | 40 | | of permits: |
---|
41 | 41 | | (1) by entities other than the department or the Texas |
---|
42 | 42 | | Department of Motor Vehicles; and |
---|
43 | 43 | | (2) for the movement of oversize or overweight |
---|
44 | 44 | | vehicles. |
---|
45 | 45 | | SECTION 3. As soon as practicable after the effective date |
---|
46 | 46 | | of this Act, the Texas Commission on Environmental Quality and the |
---|
47 | 47 | | Public Safety Commission shall adopt the requirements and rules |
---|
48 | 48 | | necessary to implement Section 382.202, Health and Safety Code, and |
---|
49 | 49 | | Section 548.301, Transportation Code, as amended by this Act. |
---|
50 | 50 | | SECTION 4. This Act takes effect immediately if it receives |
---|
51 | 51 | | a vote of two-thirds of all the members elected to each house, as |
---|
52 | 52 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
53 | 53 | | Act does not receive the vote necessary for immediate effect, this |
---|
54 | 54 | | Act takes effect September 1, 2025. |
