77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to required motor vehicle emissions inspections in certain
1010 border counties.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 382.202(c), Health and Safety Code, is
1313 amended to read as follows:
1414 (c) If the program is established under this section, the
1515 commission:
1616 (1) shall adopt vehicle emissions inspection and
1717 maintenance requirements for certain areas as required by federal
1818 law or regulation; [and]
1919 (2) shall adopt vehicle emissions inspection and
2020 maintenance requirements for counties not subject to a specific
2121 federal requirement in response to a formal request by resolutions
2222 adopted by the county and the most populous municipality within the
2323 county according to the most recent federal decennial census; and
2424 (3) shall adopt vehicle emissions inspection and
2525 maintenance requirements for counties not described by Subdivision
2626 (1) or (2) that:
2727 (A) border the United Mexican States; and
2828 (B) contain an overweight corridor, as defined by
2929 Section 548.301, Transportation Code.
3030 SECTION 2. Section 548.301, Transportation Code, is amended
3131 by adding Subsections (a-1) and (a-2) to read as follows:
3232 (a-1) The commission by rule shall establish a motor vehicle
3333 emissions inspection and maintenance program for vehicles located
3434 in a county that:
3535 (1) borders the United Mexican States; and
3636 (2) contains an overweight corridor.
3737 (a-2) For purposes of Subsection (a-1), "overweight
3838 corridor" means a designated section of a state highway for which an
3939 optional procedure is authorized under Chapter 623 for the issuance
4040 of permits:
4141 (1) by entities other than the department or the Texas
4242 Department of Motor Vehicles; and
4343 (2) for the movement of oversize or overweight
4444 vehicles.
4545 SECTION 3. As soon as practicable after the effective date
4646 of this Act, the Texas Commission on Environmental Quality and the
4747 Public Safety Commission shall adopt the requirements and rules
4848 necessary to implement Section 382.202, Health and Safety Code, and
4949 Section 548.301, Transportation Code, as amended by this Act.
5050 SECTION 4. This Act takes effect immediately if it receives
5151 a vote of two-thirds of all the members elected to each house, as
5252 provided by Section 39, Article III, Texas Constitution. If this
5353 Act does not receive the vote necessary for immediate effect, this
5454 Act takes effect September 1, 2025.
