| 8 | 8 | | relating to certain contracts for the lease, license, sale, use, or |
|---|
| 9 | 9 | | distribution of the State Bar of Texas' intellectual property. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 81.015, Government Code, is amended to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | Sec. 81.015. CONTRACTS. (a) To carry out and promote the |
|---|
| 14 | 14 | | objectives of this chapter, subject to Subsection (b), the state |
|---|
| 15 | 15 | | bar may enter into contracts and perform [do] all other acts |
|---|
| 16 | 16 | | incidental to those contracts that are necessary or expedient for |
|---|
| 17 | 17 | | the administration of its affairs and for the attainment of its |
|---|
| 18 | 18 | | purposes. |
|---|
| 19 | 19 | | (b) The state bar may not enter into a contract authorizing |
|---|
| 20 | 20 | | an entity to exclusively lease, license, sell, use, or otherwise |
|---|
| 21 | 21 | | distribute the state bar's intellectual property. Such contracts |
|---|
| 22 | 22 | | must be offered to all interested entities using a standard |
|---|
| 23 | 23 | | contract providing identical terms and conditions to all entities. |

| 24 | 24 | | SECTION 2. Section 81.0151, Government Code, is amended to |
|---|
| 25 | 25 | | read as follows: |
|---|
| 26 | 26 | | Sec. 81.0151. PURCHASING. (a) The board of directors shall |
|---|
| 27 | 27 | | adopt guidelines and procedures for purchasing that are consistent |
|---|
| 28 | 28 | | with the guidelines and procedures in Chapters 2155-2158. |
|---|
| 29 | 29 | | (b) State bar purchases [Purchases] are subject to the |
|---|
| 30 | 30 | | ultimate review of the supreme court. The state bar shall maintain |
|---|
| 31 | 31 | | reports on the [state bar] purchases and shall make those reports |
|---|
| 32 | 32 | | available for review by the state auditor. |
|---|
| 33 | 33 | | SECTION 3. The changes in law made by this Act apply only to |
|---|
| 34 | 34 | | a contract for the lease, license, sale, use, or other distribution |
|---|
| 35 | 35 | | of the State Bar of Texas' intellectual property that is entered |
|---|
| 36 | 36 | | into on or after the effective date of this Act. |
|---|
| 37 | 37 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 38 | 38 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 39 | 39 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 40 | 40 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 41 | 41 | | Act takes effect September 1, 2025. |
