77 AN ACT
88 relating to the authority of a municipality to prohibit police or
99 fire department employees from circulating or signing certain
1010 employment petitions.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 150, Local Government Code, is amended
1313 by adding Subchapter Z to read as follows:
1414 SUBCHAPTER Z. MISCELLANEOUS PROVISIONS
1515 Sec. 150.901. AUTHORITY TO PROHIBIT POLICE OR FIRE
1616 DEPARTMENT EMPLOYEES FROM CIRCULATING OR SIGNING CERTAIN
1717 PETITIONS. A municipality may not adopt or enforce a charter
1818 provision, ordinance, policy, or other measure that prohibits an
1919 employee of the municipality's police or fire department from
2020 circulating or signing a petition authorized by Chapter 142, 143,
2121 or 174.
2222 SECTION 2. This Act takes effect immediately if it receives
2323 a vote of two-thirds of all the members elected to each house, as
2424 provided by Section 39, Article III, Texas Constitution. If this
2525 Act does not receive the vote necessary for immediate effect, this
2626 Act takes effect September 1, 2025.
