88 AN ACT
99 relating to immunity from criminal liability for certain health
1010 care practitioners.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle H, Title 2, Health and Safety Code, is
1313 amended by adding Chapter 174 to read as follows:
1414 CHAPTER 174. IMMUNITY FROM CRIMINAL LIABILITY FOR HEALTH CARE
1515 PRACTITIONERS
1616 Sec. 174.001. DEFINITIONS. In this chapter:
1717 (1) "Health care practitioner" means an individual
1818 who:
1919 (A) provides a health care service at one of the
2020 following facilities:
2121 (i) a home and community support services
2222 agency licensed or licensed and certified under Chapter 142;
2323 (ii) a hospital licensed under Chapter 241
2424 or a hospital maintained or operated by an agency of this state that
2525 is exempt from licensing under that chapter;
2626 (iii) a nursing facility licensed under
2727 Chapter 242;
2828 (iv) an ambulatory surgical center licensed
2929 under Chapter 243;
3030 (v) a freestanding emergency medical care
3131 facility as defined by Section 254.001; or
3232 (vi) a mental hospital licensed under
3333 Chapter 577; or
3434 (B) is licensed, certified, or registered as a:
3535 (i) physician under Chapter 155,
3636 Occupations Code;
3737 (ii) physician assistant under Chapter 204,
3838 Occupations Code;
3939 (iii) surgical assistant under Chapter 206,
4040 Occupations Code; or
4141 (iv) nurse under Chapter 301, Occupations
4242 Code.
4343 (2) "Health care service" means a service within the
4444 scope of a health care practitioner's practice provided to an
4545 individual in this state. The term includes a diagnostic,
4646 treatment, or rehabilitative service.
4747 Sec. 174.002. IMMUNITY FROM CRIMINAL LIABILITY; EXCEPTION.
4848 (a) Notwithstanding any other law and except as provided by
4949 Subsection (b), a health care practitioner providing a health care
5050 service is immune from criminal liability for any harm or damage
5151 resulting from an act or omission relating to the provision of the
5252 health care service.
5353 (b) A health care practitioner is not immune from criminal
5454 liability under Subsection (a) if harm or damage results from a
5555 criminally negligent, reckless, knowing, or intentional act.
5656 Sec. 174.003. CONSTRUCTION. This chapter may not be
5757 construed to amend, repeal, or alter any other immunity, defense,
5858 limitation of liability, or procedure available under any other law
5959 or contract.
6060 SECTION 2. Section 174.002, Health and Safety Code, as
6161 added by this Act, applies only to a suspected offense that was
6262 committed, is believed to have been committed, or was discovered on
6363 or after the effective date of this Act.
6464 SECTION 3. This Act takes effect immediately if it receives
6565 a vote of two-thirds of all the members elected to each house, as
6666 provided by Section 39, Article III, Texas Constitution. If this
6767 Act does not receive the vote necessary for immediate effect, this
6868 Act takes effect September 1, 2025.
