108 AN ACT
11- relating to the care provided to sexual assault survivors by health
12- care facilities.
9+ relating to the minimum standards of care provided to sexual
10+ assault survivors by health care facilities.
1311 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
14- SECTION 1. Section 323.004, Health and Safety Code, is
15- amended by amending Subsection (b) and adding Subsection (b-2) to
16- read as follows:
12+ SECTION 1. Section 323.004(b), Health and Safety Code, is
13+ amended to read as follows:
1714 (b) A health care facility providing care to a sexual
1815 assault survivor shall provide the survivor with:
1916 (1) subject to Subsection (b-1), a forensic medical
2017 examination in accordance with Subchapter B, Chapter 420,
2118 Government Code, and Subchapter G, Chapter 56A, Code of Criminal
2219 Procedure;
2320 (2) a private area, if available, to wait or speak with
2421 the appropriate medical, legal, or sexual assault crisis center
2522 staff or volunteer until a physician, nurse, or physician assistant
2623 is able to treat the survivor;
2724 (3) access to a sexual assault program advocate, if
2825 available, as provided by Subchapter H, Chapter 56A, Code of
2926 Criminal Procedure;
3027 (4) the information form required by Section 323.005;
3128 (5) a private treatment room, if available;
3229 (6) if indicated by the history of contact, access to
3330 appropriate prophylaxis for exposure to sexually transmitted
3431 infections;
3532 (7) the name and telephone number of the nearest
3633 sexual assault crisis center; [and]
3734 (8) if the health care facility has shower facilities,
3835 access to a shower at no cost to the survivor after the examination
3936 described by Subdivision (1); and
4037 (9) if the survivor consents and the treatment is
4138 clinically indicated, an emergency contraceptive approved by the
42- United States Food and Drug Administration to prevent pregnancy by
43- delaying ovulation.
44- (b-2) A health care facility providing care to a sexual
45- assault survivor may not provide or offer to provide the survivor
46- with a drug or device that terminates a pregnancy.

4740 SECTION 2. This Act takes effect September 1, 2025.
