77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the regulation of land surveyors by the Texas Board of
1010 Professional Engineers and Land Surveyors.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 1001.216, Occupations Code, is amended
1313 by adding Subsections (a-1) and (a-2) to read as follows:
1414 (a-1) The advisory committee appointed under Subsection (a)
1515 may, on its own initiative or at the request of any interested
1616 person, prepare a written report or recommendation to the board on
1717 any surveying-related subject regulated by the board.
1818 (a-2) The advisory committee appointed under Subsection (a)
1919 shall maintain a written public record of each subject discussed
2020 and action taken at the committee's meetings.
2121 SECTION 2. Section 1001.601(a), Occupations Code, is
2222 amended to read as follows:
2323 (a) On its own initiative or at the request of any
2424 interested person, the board shall prepare a written advisory
2525 opinion about:
2626 (1) an interpretation of this chapter or Chapter 1071;
2727 or
2828 (2) the application of this chapter or Chapter 1071 to
2929 a person in regard to a specified existing or hypothetical factual
3030 situation.
3131 SECTION 3. Sections 1071.253(a) and (c), Occupations Code,
3232 are amended to read as follows:
3333 (a) An applicant for a surveyor-in-training certificate
3434 must:
3535 (1) have earned a bachelor of science degree in
3636 surveying from an accredited institution of higher education;
3737 (2) have:
3838 (A) earned a bachelor's degree from an accredited
3939 institution of higher education that included at least 32 semester
4040 hours in a combination of courses acceptable to the board in:
4141 (i) land surveying [civil engineering];
4242 (ii) civil engineering [land surveying];
4343 (iii) mathematics;
4444 (iv) photogrammetry;
4545 (v) forestry;
4646 (vi) land law; or
4747 (vii) the physical sciences; and
4848 (B) completed at least one year of experience
4949 acceptable to the board in delegated responsible charge as a
5050 subordinate to a registered professional land surveyor actively
5151 engaged in professional surveying;
5252 (3) have:
5353 (A) earned an associate degree in surveying from
5454 an accredited institution of higher education; and
5555 (B) completed at least two years of experience
5656 acceptable to the board in delegated responsible charge as a
5757 subordinate to a registered professional land surveyor actively
5858 engaged in professional surveying;
5959 (4) have:
6060 (A) successfully completed a course of
6161 instruction consisting of 32 semester hours in land surveying or
6262 the equivalent number of semester hours in board-approved courses
6363 related to surveying; and
6464 (B) completed at least two years of experience
6565 acceptable to the board in delegated responsible charge as a
6666 subordinate to a registered professional land surveyor actively
6767 engaged in professional surveying; or
6868 (5) have:
6969 (A) graduated from an accredited high school;
7070 (B) completed at least four years of experience
7171 acceptable to the board in delegated responsible charge as a
7272 subordinate to a registered professional land surveyor actively
7373 engaged in professional surveying; and
7474 (C) provided evidence satisfactory to the board
7575 that the applicant is self-educated in professional surveying.
7676 (c) On proof that an applicant meets the qualifications
7777 prescribed by Subsection (a) and has passed the fundamentals of
7878 surveying examination prescribed by the board under Section
7979 1071.256, the [The] board shall issue a surveyor-in-training
8080 certificate to the [an] applicant [who passes the applicable parts
8181 of the examination taken under Subsection (b)]. The certificate is
8282 valid for eight years.
8383 SECTION 4. Sections 1071.254(a) and (b), Occupations Code,
8484 are amended to read as follows:
8585 (a) An applicant for registration as a registered
8686 professional land surveyor must:
8787 (1) hold a certificate as a surveyor-in-training;
8888 (2) have passed the principles and practice of
8989 surveying examination prescribed by the board under Section
9090 1071.256;
9191 (3) [(2)] have at least two years of experience
9292 satisfactory to the board as a surveyor-in-training in performing
9393 surveying in delegated responsible charge as a subordinate to a
9494 surveyor registered or licensed to engage in the practice of
9595 surveying in this state or in another state having registration or
9696 licensing requirements equivalent to the requirements of this
9797 state; and
9898 (4) [(3)] have earned an associate or bachelor's
9999 degree from an accredited institution of higher education that
100100 included at least 32 semester hours in a combination of courses
101101 acceptable to the board in:
102102 (A) land surveying [civil engineering];
103103 (B) civil engineering [land surveying];
104104 (C) mathematics;
105105 (D) photogrammetry;
106106 (E) forestry;
107107 (F) land law; or
108108 (G) the physical sciences.
109109 (b) An applicant is entitled to registration as a registered
110110 professional land surveyor if the applicant meets the
111111 qualifications prescribed by Subsection (a) and is approved to take
112112 and passes the required sections of the Texas specific surveying
113113 examination prescribed under Section 1071.256.
114114 SECTION 5. Section 1071.256, Occupations Code, is amended
115115 by adding Subsections (a-1) and (b-1) and amending Subsection (b)
116116 to read as follows:
117117 (a-1) The board by rule shall prescribe the fundamentals of
118118 surveying examination required for an applicant for certification
119119 as a surveyor-in-training under Section 1071.253.
120120 (b) The board by rule shall prescribe the principles and
121121 practice of surveying examination required for an applicant for
122122 registration as a registered professional land surveyor under
123123 Section 1071.254 [must be developed and given as provided by this
124124 chapter under board rules designed] to determine the knowledge and
125125 ability of the applicant.
126126 (b-1) The board by rule shall prescribe the Texas specific
127127 surveying examination required for an applicant for registration as
128128 a registered professional land surveyor under Section 1071.254.
129129 SECTION 6. Section 1071.253(b), Occupations Code, is
130130 repealed.
131131 SECTION 7. Not later than December 1, 2025, the Texas Board
132132 of Professional Engineers and Land Surveyors shall adopt the rules
133133 necessary to implement the changes in law made by this Act.
134134 SECTION 8. Sections 1071.253 and 1071.254, Occupations
135135 Code, as amended by this Act, apply only to an application for,
136136 respectively, a surveyor-in-training certificate or registration
137137 as a registered professional land surveyor filed with the Texas
138138 Board of Professional Engineers and Land Surveyors on or after the
139139 effective date of this Act. An application filed before the
140140 effective date of this Act is governed by the law in effect on the
141141 date the application was filed, and the former law is continued in
142142 effect for that purpose.
143143 SECTION 9. This Act takes effect September 1, 2025.
