9 | 9 | | relating to inclusion of the United States Space Force in United |

10 | 10 | | States military and veteran statutory definitions. |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
12 | 12 | | SECTION 1. Section 54.241(b), Education Code, is amended to |
---|
13 | 13 | | read as follows: |
---|
14 | 14 | | (b) A person who is an officer, enlisted person, selectee, |
---|
15 | 15 | | or draftee of the Army, Army Reserve, Army National Guard, Air |
---|
16 | 16 | | National Guard, Air Force, Air Force Reserve, Space Force, Navy, |
---|
17 | 17 | | Navy Reserve, Marine Corps, Marine Corps Reserve, Coast Guard, or |
---|
18 | 18 | | Coast Guard Reserve of the United States, who is assigned to duty in |
---|
19 | 19 | | Texas, and the spouse and children of such an officer, enlisted |
---|
20 | 20 | | person, selectee, or draftee, are entitled to register in a state |
---|
21 | 21 | | institution of higher education by paying the tuition fee and other |
---|
22 | 22 | | fees or charges required of Texas residents, without regard to the |
---|
23 | 23 | | length of time the officer, enlisted person, selectee, or draftee |
---|
24 | 24 | | has been assigned to duty or resided in the state. However, |
---|
25 | 25 | | out-of-state Army National Guard or Air National Guard members |
---|
26 | 26 | | attending training with Texas Army or Air National Guard units |
---|
27 | 27 | | under National Guard Bureau regulations may not be exempted from |
---|
28 | 28 | | nonresident tuition by virtue of that training status nor may |
---|
29 | 29 | | out-of-state Army, Air Force, Space Force, Navy, Marine Corps, or |
---|
30 | 30 | | Coast Guard Reserves training with units in Texas under similar |
---|
31 | 31 | | regulations be exempted from nonresident tuition by virtue of that |
---|
32 | 32 | | training status. It is the intent of the legislature that only |
---|
33 | 33 | | those members of the Army or Air National Guard or other reserve |
---|
34 | 34 | | forces mentioned above be exempted from the nonresident tuition fee |
---|
35 | 35 | | and other fees and charges only when they become members of Texas |
---|
36 | 36 | | units of the military organizations mentioned above. |
---|
37 | 37 | | SECTION 2. Section 136.001(5), Education Code, is amended |
---|
38 | 38 | | to read as follows: |
---|
39 | 39 | | (5) "Veteran" means a person who has served in: |
---|
40 | 40 | | (A) the army, navy, air force, space force, coast |
---|
41 | 41 | | guard, or marine corps of the United States; |
---|
42 | 42 | | (B) the state military forces as defined by |
---|
43 | 43 | | Section 431.001, Government Code, other than the Texas State Guard; |
---|
44 | 44 | | or |
---|
45 | 45 | | (C) an auxiliary service of one of those branches |
---|
46 | 46 | | of the armed forces. |
---|
47 | 47 | | SECTION 3. Section 171.0251(a), Election Code, is amended |
---|
48 | 48 | | to read as follows: |
---|
49 | 49 | | (a) In this section, "armed forces of the United States" |
---|
50 | 50 | | means the United States Army, the United States Navy, the United |
---|
51 | 51 | | States Air Force, the United States Space Force, the United States |
---|
52 | 52 | | Marine Corps, the United States Coast Guard, any reserve or |
---|
53 | 53 | | auxiliary component of any of those services, or the National |
---|
54 | 54 | | Guard. |

55 | 55 | | SECTION 4. Section 411.1410(a), Government Code, is amended |
---|
56 | 56 | | to read as follows: |
---|
57 | 57 | | (a) In this section, "agency of the United States armed |
---|
58 | 58 | | forces" means the United States Army, the United States Navy, the |
---|
59 | 59 | | United States Marine Corps, the United States Coast Guard, [or] the |
---|
60 | 60 | | United States Air Force, or the United States Space Force. |
---|
61 | 61 | | SECTION 5. Section 411.1881(a), Government Code, is amended |
---|
62 | 62 | | to read as follows: |
---|
63 | 63 | | (a) Notwithstanding any other provision of this subchapter, |
---|
64 | 64 | | a person may not be required to complete the range instruction |
---|
65 | 65 | | portion of a handgun proficiency course to obtain a license issued |
---|
66 | 66 | | under this subchapter if the person: |
---|
67 | 67 | | (1) is currently serving in or is honorably discharged |
---|
68 | 68 | | from: |
---|
69 | 69 | | (A) the army, navy, air force, space force, coast |
---|
70 | 70 | | guard, or marine corps of the United States or an auxiliary service |
---|
71 | 71 | | or reserve unit of one of those branches of the armed forces; or |
---|
72 | 72 | | (B) the Texas military forces, as defined by |
---|
73 | 73 | | Section 437.001; and |
---|
74 | 74 | | (2) has, within the 10 years preceding the date of the |
---|
75 | 75 | | person's application for the license, completed as part of the |
---|
76 | 76 | | person's service with the armed forces or Texas military forces: |
---|
77 | 77 | | (A) a course of training in firearm proficiency |
---|
78 | 78 | | or familiarization; or |
---|
79 | 79 | | (B) a range qualification process for firearm |
---|
80 | 80 | | usage. |
---|
81 | 81 | | SECTION 6. Section 411.1951(a), Government Code, is amended |
---|
82 | 82 | | to read as follows: |
---|
83 | 83 | | (a) In this section, "veteran" means a person who: |
---|
84 | 84 | | (1) has served in: |
---|
85 | 85 | | (A) the army, navy, air force, space force, coast |
---|
86 | 86 | | guard, or marine corps of the United States; |

87 | 87 | | (B) the Texas military forces as defined by |
---|

158 | 158 | | performs a duty described by Section 76.004(b), regardless of |
---|
159 | 159 | | whether the officer or employee complies with Section 552.024 or |
---|
160 | 160 | | 552.1175; |
---|
161 | 161 | | (7) a current or former employee of the office of the |
---|
162 | 162 | | attorney general who is or was assigned to a division of that office |
---|
163 | 163 | | the duties of which involve law enforcement or are performed under |
---|
164 | 164 | | Chapter 231, Family Code, regardless of whether the current or |
---|
165 | 165 | | former employee complies with Section 552.024 or 552.1175; |
---|
166 | 166 | | (8) a current or former employee of the Texas Juvenile |
---|
167 | 167 | | Justice Department or of the predecessors in function of the |
---|

320 | 320 | | SECTION 16. Section 259.002(a), Health and Safety Code, is |
---|
321 | 321 | | amended to read as follows: |
---|
322 | 322 | | (a) A health care facility licensed by the department under |
---|
323 | 323 | | this subtitle or owned or operated by the state may not employ a |
---|
324 | 324 | | person to practice surgical technology in that health care facility |
---|
325 | 325 | | unless that person provides evidence that the person: |
---|
326 | 326 | | (1) has successfully completed an accredited |
---|
327 | 327 | | educational program for surgical technologists and holds and |
---|
328 | 328 | | maintains certification as a surgical technologist by: |
---|
329 | 329 | | (A) the National Board of Surgical Technology and |
---|
330 | 330 | | Surgical Assisting or its successor; |
---|
331 | 331 | | (B) the National Center for Competency Testing or |
---|
332 | 332 | | its successor; or |
---|
333 | 333 | | (C) another surgical technologist certification |
---|
334 | 334 | | program approved by the department; |
---|
335 | 335 | | (2) has completed an appropriate training program for |
---|
336 | 336 | | surgical technology in the army, navy, air force, space force, |
---|
337 | 337 | | marine corps, or coast guard of the United States or in the United |
---|
338 | 338 | | States Public Health Service; |
---|
339 | 339 | | (3) was employed to practice surgical technology in a |
---|
340 | 340 | | health care facility before September 1, 2009; or |
---|
341 | 341 | | (4) is in the service of the federal government, to the |
---|
342 | 342 | | extent the person is performing duties related to that service. |
---|
343 | 343 | | SECTION 17. Section 716.001(16), Health and Safety Code, is |
---|
344 | 344 | | amended to read as follows: |
---|
345 | 345 | | (16) "Veteran" means an individual who: |
---|
346 | 346 | | (A) has served in: |
---|
347 | 347 | | (i) the army, navy, air force, space force, |
---|
348 | 348 | | coast guard, or marine corps of the United States; |
---|
349 | 349 | | (ii) the state military forces as defined |
---|
350 | 350 | | by Section 431.001, Government Code; or |

355 | 355 | | SECTION 18. Section 773.050(c-1), Health and Safety Code, |
---|
356 | 356 | | is amended to read as follows: |
---|
357 | 357 | | (c-1) In this subsection, "United States military" means |
---|
358 | 358 | | the United States Army, the United States Navy, the United States |
---|
359 | 359 | | Air Force, the United States Space Force, the United States Marine |
---|
360 | 360 | | Corps, the United States Coast Guard, any reserve or auxiliary |
---|
361 | 361 | | component of any of those services, or the National Guard. The |
---|
362 | 362 | | executive commissioner by rule shall provide that an individual is |
