88 AN ACT
99 relating to inclusion of the United States Space Force in United
1010 States military and veteran statutory definitions.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 54.241(b), Education Code, is amended to
1313 read as follows:
1414 (b) A person who is an officer, enlisted person, selectee,
1515 or draftee of the Army, Army Reserve, Army National Guard, Air
1616 National Guard, Air Force, Air Force Reserve, Space Force, Navy,
1717 Navy Reserve, Marine Corps, Marine Corps Reserve, Coast Guard, or
1818 Coast Guard Reserve of the United States, who is assigned to duty in
1919 Texas, and the spouse and children of such an officer, enlisted
2020 person, selectee, or draftee, are entitled to register in a state
2121 institution of higher education by paying the tuition fee and other
2222 fees or charges required of Texas residents, without regard to the
2323 length of time the officer, enlisted person, selectee, or draftee
2424 has been assigned to duty or resided in the state. However,
2525 out-of-state Army National Guard or Air National Guard members
2626 attending training with Texas Army or Air National Guard units
2727 under National Guard Bureau regulations may not be exempted from
2828 nonresident tuition by virtue of that training status nor may
2929 out-of-state Army, Air Force, Space Force, Navy, Marine Corps, or
3030 Coast Guard Reserves training with units in Texas under similar
3131 regulations be exempted from nonresident tuition by virtue of that
3232 training status. It is the intent of the legislature that only
3333 those members of the Army or Air National Guard or other reserve
3434 forces mentioned above be exempted from the nonresident tuition fee
3535 and other fees and charges only when they become members of Texas
3636 units of the military organizations mentioned above.
3737 SECTION 2. Section 136.001(5), Education Code, is amended
3838 to read as follows:
3939 (5) "Veteran" means a person who has served in:
4040 (A) the army, navy, air force, space force, coast
4141 guard, or marine corps of the United States;
4242 (B) the state military forces as defined by
4343 Section 431.001, Government Code, other than the Texas State Guard;
4444 or
4545 (C) an auxiliary service of one of those branches
4646 of the armed forces.
4747 SECTION 3. Section 171.0251(a), Election Code, is amended
4848 to read as follows:
4949 (a) In this section, "armed forces of the United States"
5050 means the United States Army, the United States Navy, the United
5151 States Air Force, the United States Space Force, the United States
5252 Marine Corps, the United States Coast Guard, any reserve or
5353 auxiliary component of any of those services, or the National
5454 Guard.
5555 SECTION 4. Section 411.1410(a), Government Code, is amended
5656 to read as follows:
5757 (a) In this section, "agency of the United States armed
5858 forces" means the United States Army, the United States Navy, the
5959 United States Marine Corps, the United States Coast Guard, [or] the
6060 United States Air Force, or the United States Space Force.
6161 SECTION 5. Section 411.1881(a), Government Code, is amended
6262 to read as follows:
6363 (a) Notwithstanding any other provision of this subchapter,
6464 a person may not be required to complete the range instruction
6565 portion of a handgun proficiency course to obtain a license issued
6666 under this subchapter if the person:
6767 (1) is currently serving in or is honorably discharged
6868 from:
6969 (A) the army, navy, air force, space force, coast
7070 guard, or marine corps of the United States or an auxiliary service
7171 or reserve unit of one of those branches of the armed forces; or
7272 (B) the Texas military forces, as defined by
7373 Section 437.001; and
7474 (2) has, within the 10 years preceding the date of the
7575 person's application for the license, completed as part of the
7676 person's service with the armed forces or Texas military forces:
7777 (A) a course of training in firearm proficiency
7878 or familiarization; or
7979 (B) a range qualification process for firearm
8080 usage.
8181 SECTION 6. Section 411.1951(a), Government Code, is amended
8282 to read as follows:
8383 (a) In this section, "veteran" means a person who:
8484 (1) has served in:
8585 (A) the army, navy, air force, space force, coast
8686 guard, or marine corps of the United States;
8787 (B) the Texas military forces as defined by
8888 Section 437.001; or
8989 (C) an auxiliary service of one of those branches
9090 of the armed forces; and
9191 (2) has been honorably discharged from the branch of
9292 the service in which the person served.
9393 SECTION 7. Section 434.022(a), Government Code, is amended
9494 to read as follows:
9595 (a) In this section, "veteran" means a person who has served
9696 in:
9797 (1) the army, navy, air force, space force, coast
9898 guard, or marine corps of the United States; or
9999 (2) the Texas National Guard as defined by Section
100100 431.001.
101101 SECTION 8. Section 434.023(a), Government Code, is amended
102102 to read as follows:
103103 (a) In this section, "veteran" means a person who has served
104104 in:
105105 (1) the army, navy, air force, space force, coast
106106 guard, or marine corps of the United States; or
107107 (2) the Texas National Guard as defined by Section
108108 431.001.
109109 SECTION 9. Section 434.351(3), Government Code, is amended
110110 to read as follows:
111111 (3) "Veteran" means a person who has served in:
112112 (A) the army, navy, air force, space force, coast
113113 guard, or marine corps of the United States;
114114 (B) the state military forces as defined by
115115 Section 431.001; or
116116 (C) an auxiliary service of one of those branches
117117 of the armed forces.
118118 SECTION 10. Section 526.0602(a), Government Code, is
119119 amended to read as follows:
120120 (a) In this section, "service member" means a member of the
121121 United States military serving in the army, navy, air force, space
122122 force, marine corps, or coast guard on active duty.
123123 SECTION 11. Section 531.0931(a), Government Code, is
124124 amended to read as follows:
125125 (a) In this section, "military member" means a member of the
126126 United States military serving in the army, navy, air force, space
127127 force, marine corps, or coast guard on active duty.
128128 SECTION 12. Section 552.117(a), Government Code, is amended
129129 to read as follows:
130130 (a) Information is excepted from the requirements of
131131 Section 552.021 if it is information that relates to the home
132132 address, home telephone number, emergency contact information, or
133133 social security number of the following person or that reveals
134134 whether the person has family members:
135135 (1) a current or former official or employee of a
136136 governmental body, except as otherwise provided by Section 552.024;
137137 (2) a current or honorably retired peace officer as
138138 defined by Article 2A.001, Code of Criminal Procedure, or a current
139139 or honorably retired security officer commissioned under Section
140140 51.212, Education Code, regardless of whether the officer complies
141141 with Section 552.024 or 552.1175, as applicable;
142142 (3) a current or former employee of the Texas
143143 Department of Criminal Justice or of the predecessor in function of
144144 the department or any division of the department, regardless of
145145 whether the current or former employee complies with Section
146146 552.1175;
147147 (4) a peace officer as defined by Article 2A.001, Code
148148 of Criminal Procedure, or other law, a reserve law enforcement
149149 officer, a commissioned deputy game warden, or a corrections
150150 officer in a municipal, county, or state penal institution in this
151151 state who was killed in the line of duty, regardless of whether the
152152 deceased complied with Section 552.024 or 552.1175;
153153 (5) a commissioned security officer as defined by
154154 Section 1702.002, Occupations Code, regardless of whether the
155155 officer complies with Section 552.024 or 552.1175, as applicable;
156156 (6) an officer or employee of a community supervision
157157 and corrections department established under Chapter 76 who
158158 performs a duty described by Section 76.004(b), regardless of
159159 whether the officer or employee complies with Section 552.024 or
160160 552.1175;
161161 (7) a current or former employee of the office of the
162162 attorney general who is or was assigned to a division of that office
163163 the duties of which involve law enforcement or are performed under
164164 Chapter 231, Family Code, regardless of whether the current or
165165 former employee complies with Section 552.024 or 552.1175;
166166 (8) a current or former employee of the Texas Juvenile
167167 Justice Department or of the predecessors in function of the
168168 department, regardless of whether the current or former employee
169169 complies with Section 552.024 or 552.1175;
170170 (9) a current or former juvenile probation or
171171 supervision officer certified by the Texas Juvenile Justice
172172 Department, or the predecessors in function of the department,
173173 under Title 12, Human Resources Code, regardless of whether the
174174 current or former officer complies with Section 552.024 or
175175 552.1175;
176176 (10) a current or former employee of a juvenile
177177 justice program or facility, as those terms are defined by Section
178178 261.405, Family Code, regardless of whether the current or former
179179 employee complies with Section 552.024 or 552.1175;
180180 (11) a current or former member of the United States
181181 Army, Navy, Air Force, Space Force, Coast Guard, or Marine Corps, an
182182 auxiliary service of one of those branches of the armed forces, or
183183 the Texas military forces, as that term is defined by Section
184184 437.001;
185185 (12) a current or former district attorney, criminal
186186 district attorney, or county or municipal attorney whose
187187 jurisdiction includes any criminal law or child protective services
188188 matters, regardless of whether the current or former attorney
189189 complies with Section 552.024 or 552.1175;
190190 (13) a current or former employee of a district
191191 attorney, criminal district attorney, or county or municipal
192192 attorney whose jurisdiction includes any criminal law or child
193193 protective services matters, regardless of whether the current or
194194 former employee complies with Section 552.024 or 552.1175;
195195 (14) a current or former employee of the Texas Civil
196196 Commitment Office or of the predecessor in function of the office or
197197 a division of the office, regardless of whether the current or
198198 former employee complies with Section 552.024 or 552.1175;
199199 (15) a current or former federal judge or state judge,
200200 as those terms are defined by Section 1.005, Election Code, a
201201 federal bankruptcy judge, a marshal of the United States Marshals
202202 Service, a United States attorney, or a family member of a current
203203 or former federal judge, including a federal bankruptcy judge, a
204204 marshal of the United States Marshals Service, a United States
205205 attorney, or a state judge;
206206 (16) a current or former child protective services
207207 caseworker, adult protective services caseworker, or investigator
208208 for the Department of Family and Protective Services, regardless of
209209 whether the caseworker or investigator complies with Section
210210 552.024 or 552.1175, or a current or former employee of a department
211211 contractor performing child protective services caseworker, adult
212212 protective services caseworker, or investigator functions for the
213213 contractor on behalf of the department;
214214 (17) an elected public officer, regardless of whether
215215 the officer complies with Section 552.024 or 552.1175;
216216 (18) a current or former United States attorney,
217217 assistant United States attorney, federal public defender, deputy
218218 federal public defender, or assistant federal public defender and
219219 the spouse or child of the current or former attorney or public
220220 defender, regardless of whether the person complies with Section
221221 552.024 or 552.1175; or
222222 (19) a firefighter or volunteer firefighter or
223223 emergency medical services personnel as defined by Section 773.003,
224224 Health and Safety Code, regardless of whether the firefighter or
225225 volunteer firefighter or emergency medical services personnel
226226 comply with Section 552.024 or 552.1175, as applicable.
227227 SECTION 13. Section 552.1175(a), Government Code, is
228228 amended to read as follows:
229229 (a) This section applies only to:
230230 (1) current or honorably retired peace officers as
231231 defined by Article 2A.001, Code of Criminal Procedure, or special
232232 investigators as described by Article 2A.002, Code of Criminal
233233 Procedure;
234234 (2) current or honorably retired county jailers as
235235 defined by Section 1701.001, Occupations Code;
236236 (3) current or former employees of the Texas
237237 Department of Criminal Justice or of the predecessor in function of
238238 the department or any division of the department;
239239 (4) commissioned security officers as defined by
240240 Section 1702.002, Occupations Code;
241241 (5) a current or former district attorney, criminal
242242 district attorney, or county or municipal attorney whose
243243 jurisdiction includes any criminal law or child protective services
244244 matters;
245245 (5-a) a current or former employee of a district
246246 attorney, criminal district attorney, or county or municipal
247247 attorney whose jurisdiction includes any criminal law or child
248248 protective services matters;
249249 (6) officers and employees of a community supervision
250250 and corrections department established under Chapter 76 who perform
251251 a duty described by Section 76.004(b);
252252 (7) criminal investigators of the United States as
253253 described by Article 2A.002(a), Code of Criminal Procedure;
254254 (8) current or honorably retired police officers and
255255 inspectors of the United States Federal Protective Service;
256256 (9) current and former employees of the office of the
257257 attorney general who are or were assigned to a division of that
258258 office the duties of which involve law enforcement or are performed
259259 under Chapter 231, Family Code;
260260 (10) current or former juvenile probation and
261261 detention officers certified by the Texas Juvenile Justice
262262 Department, or the predecessors in function of the department,
263263 under Title 12, Human Resources Code;
264264 (11) current or former employees of a juvenile justice
265265 program or facility, as those terms are defined by Section 261.405,
266266 Family Code;
267267 (12) current or former employees of the Texas Juvenile
268268 Justice Department or the predecessors in function of the
269269 department;
270270 (13) federal judges and state judges as defined by
271271 Section 1.005, Election Code;
272272 (14) current or former employees of the Texas Civil
273273 Commitment Office or of the predecessor in function of the office or
274274 a division of the office;
275275 (15) a current or former member of the United States
276276 Army, Navy, Air Force, Space Force, Coast Guard, or Marine Corps, an
277277 auxiliary service of one of those branches of the armed forces, or
278278 the Texas military forces, as that term is defined by Section
279279 437.001;
280280 (16) a current or former child protective services
281281 caseworker, adult protective services caseworker, or investigator
282282 for the Department of Family and Protective Services or a current or
283283 former employee of a department contractor performing child
284284 protective services caseworker, adult protective services
285285 caseworker, or investigator functions for the contractor on behalf
286286 of the department;
287287 (17) an elected public officer;
288288 (18) a firefighter or volunteer firefighter or
289289 emergency medical services personnel as defined by Section 773.003,
290290 Health and Safety Code; and
291291 (19) a current or former United States attorney,
292292 assistant United States attorney, federal public defender, deputy
293293 federal public defender, or assistant federal public defender.
294294 SECTION 14. Section 2303.003(9), Government Code, is
295295 amended to read as follows:
296296 (9) "Veteran" means a person who:
297297 (A) has served in:
298298 (i) the army, navy, air force, space force,
299299 coast guard, or marine corps of the United States;
300300 (ii) the state military forces as defined
301301 by Section 431.001; or
302302 (iii) an auxiliary service of one of those
303303 branches of the armed forces; and
304304 (B) has been honorably discharged from the branch
305305 of the service in which the person served.
306306 SECTION 15. Section 2308.251(2), Government Code, is
307307 amended to read as follows:
308308 (2) "Veteran" means a person who:
309309 (A) has served in:
310310 (i) the army, navy, air force, space force,
311311 coast guard, or marine corps of the United States or the United
312312 States Public Health Service under 42 U.S.C. Section 201 et seq., as
313313 amended;
314314 (ii) the Texas military forces as defined
315315 by Section 437.001; or
316316 (iii) an auxiliary service of one of those
317317 branches of the armed forces; and
318318 (B) has been honorably discharged from the branch
319319 of the service in which the person served.
320320 SECTION 16. Section 259.002(a), Health and Safety Code, is
321321 amended to read as follows:
322322 (a) A health care facility licensed by the department under
323323 this subtitle or owned or operated by the state may not employ a
324324 person to practice surgical technology in that health care facility
325325 unless that person provides evidence that the person:
326326 (1) has successfully completed an accredited
327327 educational program for surgical technologists and holds and
328328 maintains certification as a surgical technologist by:
329329 (A) the National Board of Surgical Technology and
330330 Surgical Assisting or its successor;
331331 (B) the National Center for Competency Testing or
332332 its successor; or
333333 (C) another surgical technologist certification
334334 program approved by the department;
335335 (2) has completed an appropriate training program for
336336 surgical technology in the army, navy, air force, space force,
337337 marine corps, or coast guard of the United States or in the United
338338 States Public Health Service;
339339 (3) was employed to practice surgical technology in a
340340 health care facility before September 1, 2009; or
341341 (4) is in the service of the federal government, to the
342342 extent the person is performing duties related to that service.
343343 SECTION 17. Section 716.001(16), Health and Safety Code, is
344344 amended to read as follows:
345345 (16) "Veteran" means an individual who:
346346 (A) has served in:
347347 (i) the army, navy, air force, space force,
348348 coast guard, or marine corps of the United States;
349349 (ii) the state military forces as defined
350350 by Section 431.001, Government Code; or
351351 (iii) an auxiliary service of one of those
352352 branches of the armed forces; and
353353 (B) has been honorably discharged from the branch
354354 of the service in which the individual served.
355355 SECTION 18. Section 773.050(c-1), Health and Safety Code,
356356 is amended to read as follows:
357357 (c-1) In this subsection, "United States military" means
358358 the United States Army, the United States Navy, the United States
359359 Air Force, the United States Space Force, the United States Marine
360360 Corps, the United States Coast Guard, any reserve or auxiliary
361361 component of any of those services, or the National Guard. The
362362 executive commissioner by rule shall provide that an individual is
363363 eligible for emergency medical services personnel certification
364364 through reciprocity if the individual:
365365 (1) successfully completed emergency medical services
366366 training provided by the United States military;
367367 (2) has emergency medical services personnel
368368 credentials from the United States military; and
369369 (3) is certified by the National Registry of Emergency
370370 Medical Technicians.
371371 SECTION 19. Section 1001.221(2), Health and Safety Code, is
372372 amended to read as follows:
373373 (2) "Veteran" means a person who has served in:
374374 (A) the army, navy, air force, space force, coast
375375 guard, or marine corps of the United States;
376376 (B) the state military forces as defined by
377377 Section 431.001, Government Code; or
378378 (C) an auxiliary service of one of those branches
379379 of the armed forces.
380380 SECTION 20. Section 137.201, Human Resources Code, is
381381 amended to read as follows:
382382 Sec. 137.201. DEFINITIONS. In this subchapter, "veteran"
383383 means a person who has served in:
384384 (1) the army, navy, air force, space force, coast
385385 guard, or marine corps of the United States;
386386 (2) the state military forces as defined by Section
387387 431.001, Government Code; or
388388 (3) an auxiliary service of one of those branches of
389389 the armed forces.
390390 SECTION 21. Section 501.002(12), Local Government Code, is
391391 amended to read as follows:
392392 (12) "Primary job" means:
393393 (A) a job that is:
394394 (i) available at a company for which a
395395 majority of the products or services of that company are ultimately
396396 exported to regional, statewide, national, or international
397397 markets infusing new dollars into the local economy; and
398398 (ii) included in one of the following
399399 sectors of the North American Industry Classification System

440440 SECTION 22. Section 161.001(a)(7), Natural Resources Code,
441441 is amended to read as follows:
442442 (7) "Veteran" means a person who:
443443 (A)(i) served not less than 90 days, unless
444444 sooner discharged by reason of a service-connected disability, on
445445 active duty in the Army, Navy, Air Force, Space Force, Coast Guard,
446446 United States Public Health Service (as constituted under 42 U.S.C.
447447 Section 201 et seq.), or Marine Corps of the United States after
448448 September 16, 1940, and who on the date of filing an application
449449 under the program has not been dishonorably discharged from the
450450 branch of the service in which the person served;
451451 (ii) has at least 20 years of active or
452452 reserve military service as computed when determining the person's
453453 eligibility to receive retired pay under applicable federal law;
454454 (iii) has enlisted or received an
455455 appointment in the Texas National Guard, who has completed all
456456 initial active duty training required as a condition of the
457457 enlistment or appointment, and who on the date of filing the
458458 person's application has not been dishonorably discharged from the
459459 Texas National Guard; or
460460 (iv) served in the armed forces of the
461461 Republic of Vietnam between February 28, 1961, and May 7, 1975, if
462462 the board adopts a rule regarding these veterans under Subsection
463463 (b);
464464 (B) at the time of the person's enlistment,
465465 induction, commissioning, appointment, or drafting was a bona fide
466466 resident of this state or has resided in this state at least one
467467 year immediately before the date of filing an application under
468468 this chapter; and
469469 (C) at the time of the person's application under
470470 this chapter is a bona fide resident of this state. The term
471471 includes the unmarried surviving spouse of a veteran who died or who
472472 is identified as missing in action if the deceased or missing
473473 veteran meets the requirements of this section, with the exception
474474 that the deceased or missing veteran need not have served 90 days
475475 under Paragraph (A)(i) of this subdivision, and if the deceased or
476476 missing veteran was a bona fide resident of this state at the time
477477 of enlistment, induction, commissioning, appointment, or drafting.
478478 SECTION 23. Section 202.304(a), Occupations Code, is
479479 amended to read as follows:
480480 (a) Except as provided by Subsection (c), this section
481481 applies to a podiatrist whose license has been suspended or
482482 revoked, or whose most recently issued renewal certificate has
483483 expired, while the podiatrist has been:
484484 (1) engaged in federal service or on active duty with:
485485 (A) the United States Army;
486486 (B) the United States Navy;
487487 (C) the United States Marine Corps;
488488 (D) the United States Coast Guard; [or]
489489 (E) the United States Air Force; or
490490 (F) the United States Space Force;
491491 (2) called into service or training of the United
492492 States; or
493493 (3) in training or education under the supervision of
494494 the United States before induction into military service.
495495 SECTION 24. Section 451.003, Occupations Code, is amended
496496 to read as follows:
497497 Sec. 451.003. APPLICABILITY. This chapter does not apply
498498 to:
499499 (1) a physician licensed by the Texas Medical Board or
500500 engaged in the practice of medicine as authorized by Section
501501 151.0521;
502502 (2) a dentist, licensed under the laws of this state,

509509 (5) a nurse engaged in the practice of nursing;
510510 (6) a licensed podiatrist engaged in the practice of
511511 podiatry as defined by statute;
512512 (7) a physical therapist engaged in the practice of
513513 physical therapy;
514514 (8) a registered massage therapist engaged in the
515515 practice of massage therapy;
516516 (9) a commissioned or contract physician, physical
517517 therapist, or physical therapist assistant in the United States
518518 Army, Navy, Air Force, Space Force, or Public Health Service; or
519519 (10) an athletic trainer who does not live in this
520520 state, who is licensed, registered, or certified by an authority
521521 recognized by the department, and who provides athletic training in
522522 this state for a period determined by the department.
523523 SECTION 25. Section 1701.265(a), Occupations Code, is
524524 amended to read as follows:
525525 (a) In this section, "veteran" means a person who has served
526526 in:
527527 (1) the army, navy, air force, space force, coast
528528 guard, or marine corps of the United States; or
529529 (2) the Texas National Guard as defined by Section
530530 431.001, Government Code.
531531 SECTION 26. Section 312.0021(a)(1), Tax Code, is amended to
532532 read as follows:
533533 (1) "Military aviation facility" means a base,
534534 station, fort, or camp at which fixed-wing aviation operations or
535535 training is conducted by the United States Air Force, the United
536536 States Air Force Reserve, the United States Space Force, the United
537537 States Army, the United States Army Reserve, the United States
538538 Navy, the United States Navy Reserve, the United States Marine
539539 Corps, the United States Marine Corps Reserve, the United States
540540 Coast Guard, the United States Coast Guard Reserve, or the Texas
541541 National Guard.
542542 SECTION 27. Section 521.1235(a)(3), Transportation Code,
543543 is amended to read as follows:
544544 (3) "Veteran" means a person who:
545545 (A) has served in:
546546 (i) the army, navy, air force, space force,
547547 coast guard, or marine corps of the United States; or
548548 (ii) the Texas National Guard as defined by
549549 Section 437.001, Government Code; and
550550 (B) has been honorably discharged from the branch
551551 of the service in which the person served.
552552 SECTION 28. The changes in law made by this Act are intended
553553 to clarify rather than change existing law.
554554 SECTION 29. This Act takes effect September 1, 2025.
