9 | 9 | | relating to the establishment of an energy efficiency program for |

10 | 10 | | school districts and open-enrollment charter schools. |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 447.003, Government Code, is amended to |
---|
13 | 13 | | read as follows: |
---|
14 | 14 | | Sec. 447.003. LIAISON TO FEDERAL GOVERNMENT. The state |
---|
15 | 15 | | energy conservation office is the state liaison to the federal |
---|
16 | 16 | | government for the implementation and administration of federal |
---|
17 | 17 | | programs relating to state agency energy matters. The office shall |
---|
18 | 18 | | administer state programs established under: |
---|
19 | 19 | | (1) Part D, Title III, Energy Policy and Conservation |
---|
20 | 20 | | Act (42 U.S.C. Section 6321 et seq.), and its subsequent |
---|
21 | 21 | | amendments; |
---|
22 | 22 | | (2) Part G, Title III, Energy Policy and Conservation |
---|
23 | 23 | | Act (42 U.S.C. Section 6371 et seq.), and its subsequent |
---|
24 | 24 | | amendments; [and] |
---|
25 | 25 | | (3) the Clean School Bus Program and other energy |
---|
26 | 26 | | conservation, resilience, and reliability programs established by |
---|
27 | 27 | | the Infrastructure Investment and Jobs Act (Pub. L. No. 117-58), |
---|
28 | 28 | | and its subsequent amendments; and |
---|
29 | 29 | | (4) other federal energy conservation programs as |
---|
30 | 30 | | assigned to the office by the governor or the legislature. |
---|
31 | 31 | | SECTION 2. Section 2305.031, Government Code, is amended to |
---|
32 | 32 | | read as follows: |
---|
33 | 33 | | Sec. 2305.031. OIL OVERCHARGE PROGRAMS. (a) The energy |
---|
34 | 34 | | office shall maintain a revolving loan program for the benefit of: |
---|
35 | 35 | | (1) state agencies, universities, and political |
---|
36 | 36 | | subdivisions; and |
---|
37 | 37 | | (2) open-enrollment charter schools for the purposes |
---|
38 | 38 | | of Section 2305.040. |
---|
39 | 39 | | (b) The energy office shall use oil overcharge funds for the |
---|
40 | 40 | | programs and purposes in this subchapter. |
---|
41 | 41 | | SECTION 3. Subchapter D, Chapter 2305, Government Code, is |
---|
42 | 42 | | amended by adding Section 2305.040 to read as follows: |
---|
43 | 43 | | Sec. 2305.040. ENERGY EFFICIENT SCHOOLS PROGRAM. (a) In |
---|
44 | 44 | | this section, "bus" means a bus operated by or contracted for use by |
---|
45 | 45 | | a school district or open-enrollment charter school to transport |
---|
46 | 46 | | schoolchildren. |
---|
47 | 47 | | (b) The energy efficient schools program is a program to |
---|
48 | 48 | | promote, facilitate, and support the use of electric buses and |
---|
49 | 49 | | solar panels by school districts and open-enrollment charter |
---|
50 | 50 | | schools through grants, partnerships, and loans. |
---|
51 | 51 | | (c) The energy office is the supervising agency for the |
---|
52 | 52 | | energy efficient schools program. |
---|
53 | 53 | | (d) A project funded under the energy efficient schools |
---|
54 | 54 | | program may include: |
---|
55 | 55 | | (1) the acquisition of electric buses and charging |
---|
56 | 56 | | stations by school districts and open-enrollment charter schools; |
---|
57 | 57 | | (2) the acquisition of solar panels for school |
---|
58 | 58 | | campuses by school districts and open-enrollment charter schools; |
---|
59 | 59 | | and |
---|
60 | 60 | | (3) electricity storage projects to provide efficient |
---|
61 | 61 | | means of making stored energy available during periods of peak |
---|
62 | 62 | | energy use, including: |
---|
63 | 63 | | (A) projects to store electricity in buses; and |
---|
64 | 64 | | (B) projects to store electricity produced from |
---|
65 | 65 | | solar generation. |
---|
66 | 66 | | SECTION 4. This Act takes effect September 1, 2025. |
