77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the establishment of an energy efficiency program for
1010 school districts and open-enrollment charter schools.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 447.003, Government Code, is amended to
1313 read as follows:
1414 Sec. 447.003. LIAISON TO FEDERAL GOVERNMENT. The state
1515 energy conservation office is the state liaison to the federal
1616 government for the implementation and administration of federal
1717 programs relating to state agency energy matters. The office shall
1818 administer state programs established under:
1919 (1) Part D, Title III, Energy Policy and Conservation
2020 Act (42 U.S.C. Section 6321 et seq.), and its subsequent
2121 amendments;
2222 (2) Part G, Title III, Energy Policy and Conservation
2323 Act (42 U.S.C. Section 6371 et seq.), and its subsequent
2424 amendments; [and]
2525 (3) the Clean School Bus Program and other energy
2626 conservation, resilience, and reliability programs established by
2727 the Infrastructure Investment and Jobs Act (Pub. L. No. 117-58),
2828 and its subsequent amendments; and
2929 (4) other federal energy conservation programs as
3030 assigned to the office by the governor or the legislature.
3131 SECTION 2. Section 2305.031, Government Code, is amended to
3232 read as follows:
3333 Sec. 2305.031. OIL OVERCHARGE PROGRAMS. (a) The energy
3434 office shall maintain a revolving loan program for the benefit of:
3535 (1) state agencies, universities, and political
3636 subdivisions; and
3737 (2) open-enrollment charter schools for the purposes
3838 of Section 2305.040.
3939 (b) The energy office shall use oil overcharge funds for the
4040 programs and purposes in this subchapter.
4141 SECTION 3. Subchapter D, Chapter 2305, Government Code, is
4242 amended by adding Section 2305.040 to read as follows:
4343 Sec. 2305.040. ENERGY EFFICIENT SCHOOLS PROGRAM. (a) In
4444 this section, "bus" means a bus operated by or contracted for use by
4545 a school district or open-enrollment charter school to transport
4646 schoolchildren.
4747 (b) The energy efficient schools program is a program to
4848 promote, facilitate, and support the use of electric buses and
4949 solar panels by school districts and open-enrollment charter
5050 schools through grants, partnerships, and loans.
5151 (c) The energy office is the supervising agency for the
5252 energy efficient schools program.
5353 (d) A project funded under the energy efficient schools
5454 program may include:
5555 (1) the acquisition of electric buses and charging
5656 stations by school districts and open-enrollment charter schools;
5757 (2) the acquisition of solar panels for school
5858 campuses by school districts and open-enrollment charter schools;
5959 and
6060 (3) electricity storage projects to provide efficient
6161 means of making stored energy available during periods of peak
6262 energy use, including:
6363 (A) projects to store electricity in buses; and
6464 (B) projects to store electricity produced from
6565 solar generation.
6666 SECTION 4. This Act takes effect September 1, 2025.
