88 AN ACT
99 relating to the confidentiality of eviction case information.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 24, Property Code, is amended by adding
1212 Section 24.012 to read as follows:
1313 Sec. 24.012. CONFIDENTIAL EVICTION CASE INFORMATION. (a)
1414 In this section:
1515 (1) "Consumer reporting agency" has the meaning
1616 assigned by Section 20.01, Business & Commerce Code.
1717 (2) "Eviction case" means a lawsuit brought under this
1818 chapter to recover possession of leased or rented real property
1919 from a tenant, including a tenant at will or a tenant at sufferance.
2020 (3) "Eviction case information" means all records and
2121 files related to a filing of an eviction case, including petitions
2222 and their dispositions.
2323 (b) Concurrently with a judgment or order of dismissal in an
2424 eviction case, a court shall enter an order protecting the
2525 confidentiality of the eviction case information pertaining to a
2626 defendant if:
2727 (1) a judgment is entered in favor of the defendant;
2828 (2) the case is dismissed without any relief granted
2929 to the plaintiff; or
3030 (3) the defendant is a residential tenant not
3131 otherwise in default and the eviction case is brought by the
3232 successor in interest following foreclosure.
3333 (c) On petition of a defendant in an eviction case after a
3434 judgment or order of dismissal has been entered, a court shall enter
3535 an order protecting the confidentiality of the eviction case
3636 information pertaining to a defendant if a confidentiality order
3737 was not issued and:
3838 (1) a judgment was entered in favor of the defendant;
3939 or
4040 (2) the case was dismissed without any relief granted
4141 to the plaintiff.
4242 (d) On perfection of appeal by any party in an eviction
4343 case, a court shall enter an order protecting during the pendency of
4444 the appeal the confidentiality of the eviction case information
4545 presented in the trial court.
4646 (e) If an order is entered to protect the confidentiality of
4747 eviction case information under this section:
4848 (1) a court or clerk may not disclose the eviction case
4949 information, except:
5050 (A) to a judge or court personnel of the trial
5151 court presiding over the eviction case;
5252 (B) to the parties to the suit or the parties'
5353 counsel; or
5454 (C) in a form that omits any personal identifying
5555 information of the parties, to any other person, agency, or
5656 institution approved by the court with a legitimate and
5757 noncommercial interest in the decisions of the court; and
5858 (2) except to the extent permitted by federal law, a
5959 consumer reporting agency, a person, other than a landlord, who
6060 regularly collects and disseminates eviction case information, or a
6161 person who sells eviction case information may not:
6262 (A) disclose the existence of the eviction case;
6363 or
6464 (B) use the eviction case information as a factor
6565 in determining a score or recommendation in a tenant screening
6666 report regarding the defendant.
6767 (f) A person who knowingly violates Subsection (e)(2) is
6868 liable to an injured party for:
6969 (1) actual damages; and
7070 (2) reasonable attorney's fees and court costs.
7171 (g) This section does not prohibit a party to an eviction
7272 case from abstracting the judgment in the case.
7373 SECTION 2. This Act takes effect September 1, 2025.
