77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to contracting with companies that boycott or discriminate
1010 against certain entities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. This Act may be cited as the "Freedom of Speech
1313 Act."
1414 SECTION 2. Section 403.606, Government Code, is amended to
1515 read as follows:
1616 Sec. 403.606. CERTAIN PERSONS INELIGIBLE. A person is not
1717 eligible to submit an application to the comptroller or enter into
1818 an agreement under this subchapter if the person is a company that
1919 is listed as ineligible to receive a state contract or investment
2020 under Chapter 808, 809, 2270, [2271,] or 2275 [2274, as added by
2121 Chapters 529 (S.B. 13), 530 (S.B. 19), and 975 (S.B. 2116), Acts of
2222 the 87th Legislature, Regular Session, 2021].
2323 SECTION 3. Section 2400.0015, Government Code, is amended
2424 to read as follows:
2525 Sec. 2400.0015. APPLICABILITY. This chapter does not apply
2626 to an investment prohibited under Chapter 808 [or a contract
2727 prohibited under Chapter 2271].
2828 SECTION 4. The following chapters of the Government Code
2929 are repealed:
3030 (1) Chapter 2271;
3131 (2) Chapter 2274; and
3232 (3) Chapter 2276.
3333 SECTION 5. This Act takes effect immediately if it receives
3434 a vote of two-thirds of all the members elected to each house, as
3535 provided by Section 39, Article III, Texas Constitution. If this
3636 Act does not receive the vote necessary for immediate effect, this
3737 Act takes effect September 1, 2025.
