77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the verification of the citizenship status of
1010 registered voters.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 16.0332, Election Code, is amended by
1313 amending Subsection (a) and adding Subsection (a-2) to read as
1414 follows:
1515 (a) After the registrar receives notification under
1616 Subsection (a-1) of this section, Section 18.068 of this code, or
1717 Section 62.113, Government Code, of persons excused or disqualified
1818 from jury service because of citizenship status or notification of
1919 persons who indicate a lack of citizenship status in connection
2020 with a motor vehicle or Department of Public Safety record as
2121 provided by Subsection (a-1) or other record as provided by
2222 Subsection (a-2), the registrar shall deliver to each registered
2323 voter whose name appears on the list a written notice requiring the
2424 voter to submit to the registrar proof of United States citizenship
2525 in the form of a certified copy of the voter's birth certificate,
2626 United States passport, or certificate of naturalization or any
2727 other form prescribed by the secretary of state. The notice shall
2828 be delivered by forwardable mail to the mailing address on the
2929 voter's registration application and to any new address of the
3030 voter known to the registrar.
3131 (a-2) The secretary of state shall compare on a monthly
3232 basis the citizenship status information in the existing statewide
3333 computerized voter registration list against citizenship status
3434 information available from:
3535 (1) birth certificate records maintained by any state
3636 or local government agency;
3737 (2) the American Association of Motor Vehicle
3838 Administrators;
3939 (3) the United States Department of Homeland Security;
4040 (4) the Help America Vote Verification (HAVV)
4141 information system maintained by the United States Social Security
4242 Administration; and
4343 (5) any other database containing citizenship status
4444 information the secretary of state may access.
4545 SECTION 2. This Act takes effect September 1, 2025.
