77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to air quality permits issued by the Texas Commission on
1010 Environmental Quality for certain oil and gas facilities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 382.051961(b), Health and Safety Code,
1313 is amended to read as follows:
1414 (b) The commission may not adopt a new permit by rule or a
1515 new standard permit or amend an existing permit by rule or an
1616 existing standard permit relating to a facility to which this
1717 section applies unless the commission:
1818 (1) conducts a regulatory analysis as provided by
1919 Section 2001.0225, Government Code;
2020 (2) determines, based on the evaluation of credible
2121 air quality monitoring data, that the emissions limits or other
2222 emissions-related requirements of the permit are necessary to
2323 ensure that the intent of this chapter is not contravened,
2424 including the protection of the public's health and physical
2525 property; and
2626 (3) establishes any required emissions limits or other
2727 emissions-related requirements based on:
2828 (A) the evaluation of credible air quality
2929 monitoring data; and
3030 (B) credible air quality modeling that is not
3131 based on the worst-case scenario of emissions or other worst-case
3232 modeling scenarios unless the actual air quality monitoring data
3333 and evaluation of that data indicate that the worst-case scenario
3434 of emissions or other worst-case modeling scenarios yield modeling
3535 results that reflect the actual air quality monitoring data and
3636 evaluation[; and
3737 [(4) considers whether the requirements of the permit
3838 should be imposed only on facilities that are located in a
3939 particular geographic region of the state].
4040 SECTION 2. Not later than September 1, 2026, the Texas
4141 Commission on Environmental Quality shall modify the version of 30
4242 T.A.C. Sections 106.352(a) through (k) in effect on the effective
4343 date of this Act and any other rules necessary to ensure that those
4444 sections apply statewide.
4545 SECTION 3. This Act takes effect September 1, 2025.
