| 9 | 9 | | relating to air quality permits issued by the Texas Commission on |

| 10 | 10 | | Environmental Quality for certain oil and gas facilities. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 12 | 12 | | SECTION 1. Section 382.051961(b), Health and Safety Code, |
|---|
| 13 | 13 | | is amended to read as follows: |
|---|
| 14 | 14 | | (b) The commission may not adopt a new permit by rule or a |
|---|
| 15 | 15 | | new standard permit or amend an existing permit by rule or an |
|---|
| 16 | 16 | | existing standard permit relating to a facility to which this |
|---|
| 17 | 17 | | section applies unless the commission: |
|---|
| 18 | 18 | | (1) conducts a regulatory analysis as provided by |
|---|
| 19 | 19 | | Section 2001.0225, Government Code; |
|---|
| 20 | 20 | | (2) determines, based on the evaluation of credible |
|---|
| 21 | 21 | | air quality monitoring data, that the emissions limits or other |
|---|
| 22 | 22 | | emissions-related requirements of the permit are necessary to |
|---|
| 23 | 23 | | ensure that the intent of this chapter is not contravened, |
|---|
| 24 | 24 | | including the protection of the public's health and physical |
|---|
| 25 | 25 | | property; and |
|---|
| 26 | 26 | | (3) establishes any required emissions limits or other |
|---|
| 27 | 27 | | emissions-related requirements based on: |
|---|
| 28 | 28 | | (A) the evaluation of credible air quality |
|---|
| 29 | 29 | | monitoring data; and |
|---|
| 30 | 30 | | (B) credible air quality modeling that is not |
|---|
| 31 | 31 | | based on the worst-case scenario of emissions or other worst-case |
|---|
| 32 | 32 | | modeling scenarios unless the actual air quality monitoring data |
|---|
| 33 | 33 | | and evaluation of that data indicate that the worst-case scenario |
|---|
| 34 | 34 | | of emissions or other worst-case modeling scenarios yield modeling |
|---|
| 35 | 35 | | results that reflect the actual air quality monitoring data and |
|---|
| 36 | 36 | | evaluation[; and |
|---|
| 37 | 37 | | [(4) considers whether the requirements of the permit |
|---|
| 38 | 38 | | should be imposed only on facilities that are located in a |
|---|
| 39 | 39 | | particular geographic region of the state]. |
|---|
| 40 | 40 | | SECTION 2. Not later than September 1, 2026, the Texas |
|---|
| 41 | 41 | | Commission on Environmental Quality shall modify the version of 30 |
|---|
| 42 | 42 | | T.A.C. Sections 106.352(a) through (k) in effect on the effective |
|---|
| 43 | 43 | | date of this Act and any other rules necessary to ensure that those |
|---|
| 44 | 44 | | sections apply statewide. |
|---|
| 45 | 45 | | SECTION 3. This Act takes effect September 1, 2025. |
