77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to creating the criminal offense of the manufacture of a
1010 firearm without a federal license.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 46, Penal Code, is amended by adding
1313 Section 46.051 to read as follows:
1414 Sec. 46.051. MANUFACTURE OF FIREARM WITHOUT FEDERAL LICENSE
1515 PROHIBITED. (a) A person who does not hold a federal license to
1616 manufacture firearms under 18 U.S.C. Section 923 commits an offense
1717 if the person intentionally or knowingly manufactures a firearm.
1818 (b) An offense under this section is a Class A misdemeanor.
1919 (c) If conduct that constitutes an offense under this
2020 section also constitutes an offense under any other law, the actor
2121 may be prosecuted under this section, the other law, or both.
2222 SECTION 2. This Act takes effect September 1, 2025.
