| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 24.07, Alcoholic Beverage Code, is |
|---|
| 13 | 13 | | amended to read as follows: |
|---|
| 14 | 14 | | Sec. 24.07. HOURS OF SALE. A holder of a wine only package |
|---|
| 15 | 15 | | store permit may remain open and sell malt beverages, wine, and |
|---|
| 16 | 16 | | vinous liquors, for off-premises consumption only, on any day and |
|---|
| 17 | 17 | | during the same hours as those prescribed for the sale of malt |
|---|
| 18 | 18 | | beverages under Section 105.05[, except that the permittee may not |
|---|
| 19 | 19 | | sell wine or vinous liquor containing more than 17 percent alcohol |
|---|
| 20 | 20 | | by volume on a Sunday or after 10 p.m. on any day]. |

| 21 | 21 | | SECTION 2. Section 105.01, Alcoholic Beverage Code, is |
|---|
| 22 | 22 | | amended to read as follows: |
|---|
| 23 | 23 | | Sec. 105.01. HOURS OF SALE: LIQUOR. [(a)] Except as |
|---|
| 24 | 24 | | provided in Sections 105.02, 105.03, 105.04, 105.08, and 105.091, |
|---|
| 25 | 25 | | no person may sell, offer for sale, or deliver any liquor: |
|---|
| 26 | 26 | | (1) on New Year's Day, Thanksgiving Day, or Christmas |
|---|
| 27 | 27 | | Day; or |
|---|
| 28 | 28 | | (2) outside the hours prescribed for the sale of malt |
|---|
| 29 | 29 | | beverages under Section 105.05 [on Sunday; or |
|---|
| 30 | 30 | | [(3) before 10 a.m. or after 9 p.m.] on any other day. |
|---|
| 31 | 31 | | [(b) When Christmas Day or New Year's Day falls on a Sunday, |
|---|
| 32 | 32 | | Subsection (a) of this section applies to the following Monday.] |

| 33 | 33 | | SECTION 3. Section 105.02, Alcoholic Beverage Code, is |

| 35 | 35 | | Sec. 105.02. HOURS OF SALE: WHOLESALERS AND LOCAL |

| 36 | 36 | | DISTRIBUTORS TO RETAILERS. (a) A holder of a wholesaler's permit |

| 37 | 37 | | may sell, offer for sale, or deliver liquor to a retailer anytime |
|---|
| 38 | 38 | | except [Sunday and] Christmas Day. |
|---|
| 39 | 39 | | (b) A local distributor's permittee may sell, offer for |
|---|
| 40 | 40 | | sale, or deliver liquor to a retailer during the hours prescribed |
|---|
| 41 | 41 | | for the sale and delivery of malt beverages under Section 105.051 |
|---|
| 42 | 42 | | [between 5 a.m. and 9 p.m.] on any day except[: |

| 43 | 43 | | [(1) Sunday; |
|---|
| 44 | 44 | | [(2) Christmas Day; or |
|---|
| 45 | 45 | | [(3)] a day on which a package store permittee is |

| 46 | 46 | | prohibited from selling liquor. |

| 47 | 47 | | SECTION 4. This Act takes effect September 1, 2025. |
