11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Subchapter B, Chapter 382, Health and Safety | |
13 | 13 | Code, is amended by adding Section 382.0162 to read as follows: | |
14 | 14 | Sec. 382.0162. MONITORING OF EMISSIONS FROM AGGREGATE OR | |
15 | 15 | CONCRETE FACILITIES. (a) This section applies only to a person who | |
16 | 16 | holds a permit issued under this chapter or is authorized to use a | |
17 | 17 | permit issued under this chapter relating to the operation of a | |
18 | 18 | facility: | |
19 | 19 | (1) used for the production of aggregates, as defined | |
20 | 20 | by Section 28A.001, Water Code; | |
21 | 21 | (2) used for concrete crushing; or | |
22 | 22 | (3) that is a concrete plant that performs wet | |
23 | 23 | batching, dry batching, or central mixing. | |
24 | 24 | (b) The commission by rule shall require a person described | |
25 | 25 | by Subsection (a) to conduct fence-line or property-line monitoring | |
26 | 26 | of emissions of air contaminants from the permitted facility. | |
27 | 27 | SECTION 2. This Act takes effect September 1, 2025. |
