| 11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 12 | 12 | SECTION 1. Section 202.007(a), Property Code, is amended to | |
| 13 | 13 | read as follows: | |
| 14 | 14 | (a) A property owners' association may not include or | |
| 15 | 15 | enforce a provision in a dedicatory instrument that: | |
| 16 | 16 | (1) prohibits or restricts a property owner from: | |
| 17 | 17 | (A) [(1)] implementing measures promoting | |
| 18 | 18 | solid-waste composting of vegetation, including grass clippings, | |
| 19 | 19 | leaves, or brush, or leaving grass clippings uncollected on grass; | |
| 20 | 20 | (B) [(2)] installing rain barrels or a rainwater | |
| 21 | 21 | harvesting system; | |
| 22 | 22 | (C) [(3)] implementing efficient irrigation | |
| 23 | 23 | systems, including underground drip or other drip systems; or | |
| 24 | 24 | (D) [(4)] using drought-resistant landscaping or | |
| 25 | 25 | water-conserving natural turf; or | |
| 26 | 26 | (2) requires a property owner as part of the property | |
| 27 | 27 | owner's landscaping to plant or install grass or turf or maintain | |
| 28 | 28 | living grass or turf. | |
| 29 | 29 | SECTION 2. This Act takes effect September 1, 2025. |
