77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the disclosure of certain information regarding a
1010 record of a collision or violation involving a person operating a
1111 railroad locomotive or train.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 192.005, Transportation Code, is amended
1414 to read as follows:
1515 Sec. 192.005. RECORD OF COLLISION OR VIOLATION. If a person
1616 operating a railroad locomotive or train is involved in a collision
1717 with another train, [or] a motor vehicle, or a pedestrian or is
1818 arrested for violation of a law relating to the person's operation
1919 of a railroad locomotive or train:
2020 (1) the number of or other identifying information on
2121 the person's driver's license or commercial driver's license may not
2222 be included in any report of the collision or violation; and
2323 (2) the person's involvement in the collision or
2424 violation may not be recorded in the person's individual driving
2525 record maintained by the Department of Public Safety.
2626 SECTION 2. Chapter 192, Transportation Code, is amended by
2727 adding Section 192.006 to read as follows:
2828 Sec. 192.006. DISCLOSURE OF CERTAIN INFORMATION FROM RECORD
2929 OF COLLISION OR VIOLATION. The personally identifying information
3030 of a railroad locomotive or train crew or the communications
3131 between a train crew and a law enforcement agency that are included
3232 in a report of a collision or violation described by Section
3333 192.005(1) may not be disclosed except:
3434 (1) as necessary within the scope of the person's
3535 duties:
3636 (A) to a law enforcement officer or agent; or
3737 (B) to a state attorney;
3838 (2) to the railroad company;
3939 (A) on whose tracks the collision or violation
4040 occurred; or
4141 (B) who employed the crew at the time of the
4242 collision or violation;
4343 (3) to a regulatory agency with oversight of
4444 railroads; or
4545 (4) to a person specifically authorized by court order
4646 to receive the information, if access to the information is
4747 necessary to the performance of the person's duties.
4848 SECTION 3. This Act takes effect September 1, 2025.
