| 9 | 9 | | relating to the disclosure of certain information regarding a |

| 10 | 10 | | record of a collision or violation involving a person operating a |
|---|
| 11 | 11 | | railroad locomotive or train. |
|---|
| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 13 | 13 | | SECTION 1. Section 192.005, Transportation Code, is amended |
|---|
| 14 | 14 | | to read as follows: |
|---|
| 15 | 15 | | Sec. 192.005. RECORD OF COLLISION OR VIOLATION. If a person |
|---|
| 16 | 16 | | operating a railroad locomotive or train is involved in a collision |
|---|
| 17 | 17 | | with another train, [or] a motor vehicle, or a pedestrian or is |
|---|
| 18 | 18 | | arrested for violation of a law relating to the person's operation |
|---|
| 19 | 19 | | of a railroad locomotive or train: |
|---|
| 20 | 20 | | (1) the number of or other identifying information on |
|---|
| 21 | 21 | | the person's driver's license or commercial driver's license may not |
|---|
| 22 | 22 | | be included in any report of the collision or violation; and |
|---|
| 23 | 23 | | (2) the person's involvement in the collision or |
|---|
| 24 | 24 | | violation may not be recorded in the person's individual driving |
|---|
| 25 | 25 | | record maintained by the Department of Public Safety. |
|---|
| 26 | 26 | | SECTION 2. Chapter 192, Transportation Code, is amended by |
|---|
| 27 | 27 | | adding Section 192.006 to read as follows: |
|---|
| 28 | 28 | | Sec. 192.006. DISCLOSURE OF CERTAIN INFORMATION FROM RECORD |
|---|
| 29 | 29 | | OF COLLISION OR VIOLATION. The personally identifying information |
|---|
| 30 | 30 | | of a railroad locomotive or train crew or the communications |
|---|
| 31 | 31 | | between a train crew and a law enforcement agency that are included |
|---|
| 32 | 32 | | in a report of a collision or violation described by Section |
|---|
| 33 | 33 | | 192.005(1) may not be disclosed except: |
|---|
| 34 | 34 | | (1) as necessary within the scope of the person's |
|---|
| 35 | 35 | | duties: |
|---|
| 36 | 36 | | (A) to a law enforcement officer or agent; or |
|---|
| 37 | 37 | | (B) to a state attorney; |
|---|
| 38 | 38 | | (2) to the railroad company; |
|---|
| 39 | 39 | | (A) on whose tracks the collision or violation |
|---|
| 40 | 40 | | occurred; or |
|---|
| 41 | 41 | | (B) who employed the crew at the time of the |
|---|
| 42 | 42 | | collision or violation; |
|---|
| 43 | 43 | | (3) to a regulatory agency with oversight of |
|---|
| 44 | 44 | | railroads; or |
|---|
| 45 | 45 | | (4) to a person specifically authorized by court order |
|---|
| 46 | 46 | | to receive the information, if access to the information is |
|---|
| 47 | 47 | | necessary to the performance of the person's duties. |
|---|
| 48 | 48 | | SECTION 3. This Act takes effect September 1, 2025. |
