8	8	AN ACT
9	9	relating to the notification of a municipality of electric
10	10	cooperative requests for the transfer or removal of certain pole
11	11	attachments.
12	12	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13	13	SECTION 1. Section 252.006, Utilities Code, is amended by
14	14	adding Subsection (a-1) to read as follows:
15	15	(a-1) Not later than the 10th day after the date the
16	16	electric cooperative provides notice to a cable operator under
17	17	Subsection (a), the electric cooperative shall provide the
18	18	municipality in which the pole is located with notice of the
19	19	installation of the new pole. The notice must state the location of
20	20	the pole and describe the transfer procedure for pole attachments.
21	21	SECTION 2. Section 252.007, Utilities Code, is amended by
22	22	adding Subsection (a-1) to read as follows:
23	23	(a-1) Not later than the 10th day after the date the
24	24	electric cooperative provides a cable operator with a written
25	25	request for removal under Subsection (a), the electric cooperative
26	26	shall provide the municipality in which the pole is located with
27	27	notice of the removal request. The notice must state the location
28	28	of the pole and describe the abandoned attachment.
29	29	SECTION 3. This Act takes effect immediately if it receives
30	30	a vote of two-thirds of all the members elected to each house, as
31	31	provided by Section 39, Article III, Texas Constitution. If this
32	32	Act does not receive the vote necessary for immediate effect, this
33	33	Act takes effect September 1, 2025.
