| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. The heading to Subchapter B, Chapter 109, |
|---|
| 12 | 12 | | Alcoholic Beverage Code, is amended to read as follows: |

| 13 | 13 | | SUBCHAPTER B. HOME PRODUCTION OF WINE, [ALE,] MALT BEVERAGES, OR |

| 14 | 14 | | LIQUOR[, OR BEER] |

| 15 | 15 | | SECTION 2. The heading to Section 109.21, Alcoholic |
|---|
| 16 | 16 | | Beverage Code, is amended to read as follows: |

| 17 | 17 | | Sec. 109.21. HOME PRODUCTION OF WINE, [OR] MALT BEVERAGES, |
|---|
| 18 | 18 | | OR LIQUOR. |
|---|
| 19 | 19 | | SECTION 3. Sections 109.21(a) and (b), Alcoholic Beverage |
|---|
| 20 | 20 | | Code, are amended to read as follows: |
|---|
| 21 | 21 | | (a) The head of a family or an unmarried adult may produce |
|---|
| 22 | 22 | | for the person's use or the use of the person's family not more than |
|---|
| 23 | 23 | | 200 gallons of wine, [or] malt beverages, or liquor per year. No |
|---|
| 24 | 24 | | license or permit is required. |
|---|
| 25 | 25 | | (b) The commission may prohibit the use of any ingredient it |
|---|
| 26 | 26 | | finds detrimental to health or susceptible of use to evade this |
|---|
| 27 | 27 | | code. Only wine made from the normal alcoholic fermentation of |
|---|
| 28 | 28 | | honey or the juices of dandelions or grapes, raisins, or other |
|---|
| 29 | 29 | | fruits may be produced under this section. Only malt beverages made |
|---|
| 30 | 30 | | from the normal alcoholic fermentation of malted barley with hops, |
|---|
| 31 | 31 | | or their products, and with or without other malted or unmalted |
|---|
| 32 | 32 | | cereals, may be produced under this section. The possession of |
|---|
| 33 | 33 | | wine, [or] malt beverages, or liquor produced under this section is |
|---|
| 34 | 34 | | not an offense if the person making it complies with all provisions |
|---|
| 35 | 35 | | of this section [and the wine or malt beverages are not distilled, |
|---|
| 36 | 36 | | fortified, or otherwise altered to increase their alcohol content]. |

| 37 | 37 | | SECTION 4. This Act takes effect September 1, 2025. |
