88 AN ACT
99 relating to the home production of certain alcoholic beverages.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. The heading to Subchapter B, Chapter 109,
1212 Alcoholic Beverage Code, is amended to read as follows:
1313 SUBCHAPTER B. HOME PRODUCTION OF WINE, [ALE,] MALT BEVERAGES, OR
1414 LIQUOR[, OR BEER]
1515 SECTION 2. The heading to Section 109.21, Alcoholic
1616 Beverage Code, is amended to read as follows:
1717 Sec. 109.21. HOME PRODUCTION OF WINE, [OR] MALT BEVERAGES,
1818 OR LIQUOR.
1919 SECTION 3. Sections 109.21(a) and (b), Alcoholic Beverage
2020 Code, are amended to read as follows:
2121 (a) The head of a family or an unmarried adult may produce
2222 for the person's use or the use of the person's family not more than
2323 200 gallons of wine, [or] malt beverages, or liquor per year. No
2424 license or permit is required.
2525 (b) The commission may prohibit the use of any ingredient it
2626 finds detrimental to health or susceptible of use to evade this
2727 code. Only wine made from the normal alcoholic fermentation of
2828 honey or the juices of dandelions or grapes, raisins, or other
2929 fruits may be produced under this section. Only malt beverages made
3030 from the normal alcoholic fermentation of malted barley with hops,
3131 or their products, and with or without other malted or unmalted
3232 cereals, may be produced under this section. The possession of
3333 wine, [or] malt beverages, or liquor produced under this section is
3434 not an offense if the person making it complies with all provisions
3535 of this section [and the wine or malt beverages are not distilled,
3636 fortified, or otherwise altered to increase their alcohol content].
3737 SECTION 4. This Act takes effect September 1, 2025.
