11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 259.002, Election Code, is amended by | |
13 | 13 | adding Subsection (f) to read as follows: | |
14 | 14 | (f) Unless a sign described by Subsection (b) is displayed | |
15 | 15 | in violation of a restrictive covenant permitted by this section, a | |
16 | 16 | property owners' association may not issue to the property owner | |
17 | 17 | displaying the sign any communication, including a letter, e-mail, | |
18 | 18 | or oral demand, purporting to restrict the sign's display. A | |
19 | 19 | property owner who receives a communication from a property owners' | |
20 | 20 | association issued in violation of this subsection may bring an | |
21 | 21 | action for injunctive relief under this subsection to enjoin the | |
22 | 22 | association from engaging in the practice. The court shall award | |
23 | 23 | reasonable attorney's fees to a property owner who prevails in an | |
24 | 24 | action under this subsection. | |
25 | 25 | SECTION 2. This Act takes effect September 1, 2025. |
