77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to political advertising distributed or broadcast as part
1010 of a mass text message campaign and civil penalties for required
1111 disclosures on certain political advertising.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 251.001, Election Code, is amended by
1414 amending Subdivision (16) and adding Subdivision (22) to read as
1515 follows:
1616 (16) "Political advertising" means a communication
1717 supporting or opposing a candidate for nomination or election to a
1818 public office or office of a political party, a political party, a
1919 public officer, or a measure that:
2020 (A) in return for consideration, is published in
2121 a newspaper, magazine, or other periodical or is broadcast by radio
2222 or television or as part of a mass text message campaign; or
2323 (B) appears:
2424 (i) in a pamphlet, circular, flier,
2525 billboard or other sign, bumper sticker, or similar form of written
2626 communication; or
2727 (ii) on an Internet website.
2828 (22) "Mass text message campaign" means an organized
2929 effort in which a person sends a text message to multiple recipients
3030 in support of or opposition to a candidate, a political party, a
3131 public officer, or a measure and which involves an expenditure of
3232 funds for the messages that exceed the basic cost of hardware,
3333 messaging software, and bandwidth.
3434 SECTION 2. Section 255.001, Election Code, is amended by
3535 amending Subsection (e) and adding Subsection (f) to read as
3636 follows:
3737 (e) A person who violates this section is liable to the
3838 state for a civil penalty in an amount determined by the commission
3939 not to exceed $10,000 [$4,000].
4040 (f) For purposes of assessing a civil penalty under
4141 Subsection (e), each individual text message that is distributed or
4242 broadcast as part of a mass text message campaign in violation of
4343 this section is a separate violation.
4444 SECTION 3. The changes in law made by this Act apply only to
4545 political advertising that is distributed or broadcast on or after
4646 the effective date of this Act. The distribution or broadcasting of
4747 political advertising before the effective date of this Act is
4848 governed by the law in effect on the date the political advertising
4949 was distributed or broadcast, and the former law is continued in
5050 effect for that purpose.
5151 SECTION 4. This Act takes effect September 1, 2025.
