12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Subchapter C, Chapter 25, Education Code, is |
---|
14 | 14 | | amended by adding Section 25.0875 to read as follows: |
---|
15 | 15 | | Sec. 25.0875. CERTAIN RELEASES OF STUDENT TO PARENT AFTER |
---|
16 | 16 | | SCHOOL-INITIATED COMMUNICATION PROHIBITED. (a) In this section, |
---|
17 | 17 | | "parent" includes a person standing in parental relation. |
---|
18 | 18 | | (b) Except as provided by Subsection (c), a school district |
---|
19 | 19 | | or open-enrollment charter school may not release a student to the |
---|
20 | 20 | | student's parent before the end of the instructional day and after |
---|
21 | 21 | | the parent receives a school-initiated communication if the release |
---|
22 | 22 | | of the student is: |
---|
23 | 23 | | (1) a discipline management technique; or |
---|
24 | 24 | | (2) a reaction to the student's behavior that impedes |
---|
25 | 25 | | the student's ability to learn but does not: |
---|
26 | 26 | | (A) violate the student code of conduct under |
---|
27 | 27 | | Section 37.001; or |
---|
28 | 28 | | (B) require the student's teacher to remove the |
---|
29 | 29 | | student under Section 37.002. |
---|
30 | 30 | | (c) A school district or open-enrollment charter school may |
---|
31 | 31 | | release a student to the student's parent before the end of the |
---|
32 | 32 | | instructional day if the student's release occurs because the |
---|
33 | 33 | | student is: |
---|
34 | 34 | | (1) suspended under Section 37.005; or |
---|
35 | 35 | | (2) expelled under Section 37.0052, 37.007, or |
---|
36 | 36 | | 37.0081. |
---|
37 | 37 | | SECTION 2. This Act applies beginning with the 2025-2026 |
---|
38 | 38 | | school year. |
---|
39 | 39 | | SECTION 3. This Act takes effect immediately if it receives |
---|
40 | 40 | | a vote of two-thirds of all the members elected to each house, as |
---|
41 | 41 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
42 | 42 | | Act does not receive the vote necessary for immediate effect, this |
---|
43 | 43 | | Act takes effect September 1, 2025. |
