88 AN ACT
99 relating to a health care facility grant program supporting the use
1010 of artificial intelligence technology in scanning medical images
1111 for cancer detection.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subtitle B, Title 2, Health and Safety Code, is
1414 amended by adding Chapter 56 to read as follows:
1515 CHAPTER 56. ARTIFICIAL INTELLIGENCE CANCER DETECTION GRANT PROGRAM
1616 Sec. 56.001. DEFINITIONS. In this chapter:
1717 (1) "Grant program" means the grant program for
1818 artificial intelligence cancer detection established by this
1919 chapter.
2020 (2) "Qualified applicant" means a hospital or health
2121 care facility, including a federally qualified health center,
2222 located in this state that provides medical imaging services.
2323 Sec. 56.002. ESTABLISHMENT OF GRANT PROGRAM. (a) The
2424 commission shall establish and administer a grant program to assist
2525 qualified applicants in using artificial intelligence technology
2626 to scan medical images for cancer detection.
2727 (b) The commission may award grants each state fiscal year
2828 to qualified applicants in accordance with this chapter.
2929 Sec. 56.003. APPLICATIONS. The commission shall prescribe
3030 the form and manner for a qualified applicant to apply for a grant
3131 under the grant program. A submitted application must include:
3232 (1) evidence the applicant will provide matching funds
3333 in an amount equal to at least 10 percent of the grant award amount
3434 for the proposed artificial intelligence technology;
3535 (2) a detailed plan for using the proposed artificial
3636 intelligence technology to scan medical images to detect cancer,
3737 including the manner in which the grant money will be used and the
3838 total anticipated cost of using the technology;
3939 (3) a plan for physician review of medical results
4040 identified through artificial intelligence to ensure accuracy and
4141 efficacy;
4242 (4) the number of patient records the proposed
4343 artificial intelligence technology is capable of scanning and the
4444 estimated time required for each scan; and
4545 (5) any other information the commission requires to
4646 assess the applicant's eligibility and the potential impact of the
4747 proposed artificial intelligence technology.
4848 Sec. 56.004. GRANT REQUIREMENTS. (a) The commission may
4949 only award a grant under this chapter in accordance with a contract
5050 between the commission and a grant recipient that includes
5151 conditions providing the commission with sufficient control to
5252 ensure the public purpose of improving public health is
5353 accomplished and the state receives a return benefit.
5454 (b) A grant award under the grant program:
5555 (1) may not exceed $250,000;
5656 (2) may not be awarded to more than five qualified
5757 applicants; and
5858 (3) must be awarded annually.
5959 Sec. 56.005. REQUIRED REPORT. Not later than the first
6060 anniversary of the date a grant recipient receives a grant award
6161 under the grant program, the recipient shall provide a written
6262 report to the commission that includes:
6363 (1) the number of medical images scanned and cancer
6464 cases identified using the artificial intelligence technology for
6565 which the grant was awarded;
6666 (2) any change in cancer detection rates and the time
6767 required to detect cancer as a result of the artificial
6868 intelligence technology;
6969 (3) an assessment on the comparative effectiveness of
7070 the artificial intelligence technology versus traditional methods
7171 for detecting cancer; and
7272 (4) any recommendations for further artificial
7373 intelligence use or improvement of the use of artificial
7474 intelligence technology in scanning medical imaging to detect
7575 cancer.
7676 Sec. 56.006. RULES. The executive commissioner shall adopt
7777 the rules necessary to implement this chapter.
7878 Sec. 56.007. FUNDING. The commission may accept gifts,
7979 grants, and donations from any source to administer the grant
8080 program established under this chapter. The commission may use a
8181 portion of the money appropriated to the commission for purposes of
8282 this chapter to cover the costs of administering this chapter.
8383 Sec. 56.008. EXPIRATION. This chapter expires September 1,
8484 2035.
8585 SECTION 2. This Act takes effect September 1, 2025.
