| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter Z, Chapter 39, Utilities Code, is |
|---|
| 13 | 13 | | amended by adding Section 39.920 to read as follows: |
|---|
| 14 | 14 | | Sec. 39.920. RESPONSE TO CONSERVATION APPEALS. (a) The |
|---|
| 15 | 15 | | independent organization certified under Section 39.151 for the |
|---|
| 16 | 16 | | ERCOT power region shall collect for each zip code in ERCOT |
|---|
| 17 | 17 | | information showing the response by retail electric customers in |
|---|
| 18 | 18 | | that zip code to conservation appeals issued by the independent |
|---|
| 19 | 19 | | organization. |
|---|
| 20 | 20 | | (b) Notwithstanding any provision in Chapter 17, Section |
|---|
| 21 | 21 | | 39.101, or Section 39.107: |
|---|
| 22 | 22 | | (1) the independent organization certified under |
|---|
| 23 | 23 | | Section 39.151 for the ERCOT power region may request that an |
|---|
| 24 | 24 | | electric cooperative, municipally owned utility, retail electric |
|---|
| 25 | 25 | | provider, or transmission and distribution utility provide to the |
|---|
| 26 | 26 | | independent organization information to allow the independent |
|---|
| 27 | 27 | | organization to comply with Subsection (a); and |
|---|
| 28 | 28 | | (2) in response to a request described by Subdivision |
|---|
| 29 | 29 | | (1), an electric cooperative, municipally owned utility, retail |
|---|
| 30 | 30 | | electric provider, or transmission and distribution utility shall |
|---|
| 31 | 31 | | provide the information to the independent organization. |
|---|
| 32 | 32 | | (c) An electric cooperative, municipally owned utility, |
|---|
| 33 | 33 | | retail electric provider, or transmission and distribution utility |
|---|
| 34 | 34 | | may not provide individual retail electric customer usage data or |
|---|
| 35 | 35 | | personal information to the independent organization certified |
|---|
| 36 | 36 | | under Section 39.151 for the ERCOT power region in response to a |
|---|
| 37 | 37 | | request received under this section. |
|---|
| 38 | 38 | | (d) The independent organization certified under Section |
|---|
| 39 | 39 | | 39.151 for the ERCOT power region shall: |
|---|
| 40 | 40 | | (1) at least quarterly publish on the independent |
|---|
| 41 | 41 | | organization's Internet website updated analyses of the response by |
|---|
| 42 | 42 | | retail electric customers in ERCOT to conservation appeals issued |
|---|
| 43 | 43 | | by the independent organization; and |
|---|
| 44 | 44 | | (2) submit to the legislature an annual report |
|---|
| 45 | 45 | | summarizing the analyses published under Subdivision (1). |
|---|
| 46 | 46 | | SECTION 2. This Act takes effect September 1, 2025. |
