88 AN ACT
99 relating to the establishment of the Texas Commission on Border
1010 Security and Illegal Immigration.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle C, Title 3, Government Code, is amended
1313 by adding Chapter 330 to read as follows:
1414 CHAPTER 330. TEXAS COMMISSION ON BORDER SECURITY AND ILLEGAL
1515 IMMIGRATION
1616 SUBCHAPTER A. GENERAL PROVISIONS
1717 Sec. 330.001. SHORT TITLE. This chapter is known as the
1818 Texas Commission on Border Security and Illegal Immigration Act.
1919 Sec. 330.002. DEFINITIONS. In this chapter:
2020 (1) "Commission" means the Texas Commission on Border
2121 Security and Illegal Immigration.
2222 (2) "State agency" means a department, board,
2323 commission, office, or other agency in the executive, legislative,
2424 or judicial branch of state government. The term includes an
2525 institution of higher education as defined by Section 61.003,
2626 Education Code.
2727 SUBCHAPTER B. ESTABLISHMENT OF COMMISSION
2828 Sec. 330.051. ESTABLISHMENT AND COMPOSITION. The Texas
2929 Commission on Border Security and Illegal Immigration is an
3030 advisory commission composed of 11 members as follows:
3131 (1) the lieutenant governor or the lieutenant
3232 governor's designee;
3333 (2) the speaker of the house of representatives or the
3434 speaker's designee;
3535 (3) the governor or the governor's designee;
3636 (4) the attorney general or the attorney general's
3737 designee;
3838 (5) the comptroller or the comptroller's designee;
3939 (6) three members of the house of representatives
4040 appointed by the speaker of the house of representatives, not more
4141 than two of whom may be from the same political party; and
4242 (7) three members of the senate appointed by the
4343 lieutenant governor, not more than two of whom may be from the same
4444 political party.
4545 Sec. 330.052. PRESIDING OFFICER. The governor or
4646 governor's designee or, at the discretion of the governor, the
4747 lieutenant governor or lieutenant governor's designee shall serve
4848 as presiding officer of the commission.
4949 Sec. 330.053. VOTE. A vote of the majority of the
5050 commission members present when a quorum is present is an action of
5151 the commission.
5252 Sec. 330.054. MEETINGS. The commission shall meet at least
5353 quarterly and at other times at the call of the presiding officer.
5454 Sec. 330.055. COMPENSATION; REIMBURSEMENT. A commission
5555 member is not entitled to compensation for the member's service but
5656 may receive per diem and travel expenses in accordance with the
5757 General Appropriations Act.
5858 Sec. 330.056. STAFF. The office of the governor shall staff
5959 the commission.
6060 SUBCHAPTER C. COMMISSION POWERS AND DUTIES
6161 Sec. 330.101. GENERAL POWERS AND DUTIES. The commission
6262 shall:
6363 (1) conduct a thorough review of the economic, legal,
6464 cultural, and educational impact of illegal immigration on this
6565 state and its political subdivisions;
6666 (2) conduct a thorough examination of state and
6767 federal laws relating to immigration, migration, and guest worker
6868 programs;
6969 (3) conduct a thorough review of state laws impacting
7070 illegal immigration;
7171 (4) develop a comprehensive list of infrastructure
7272 projects supporting border security in counties on the Texas-Mexico
7373 border;
7474 (5) study the impact of a state migrant worker program
7575 on providing employees to industries most in need of skilled or
7676 unskilled migrant labor;
7777 (6) develop a comprehensive, coordinated, and
7878 sustainable state plan to address:
7979 (A) illegal immigration and the influx of illegal
8080 immigration in this state;
8181 (B) immigration and the use of migrant workers in
8282 this state; and
8383 (C) integration of immigrants with residents of
8484 this state;
8585 (7) recommend to the governor and the legislature
8686 administrative and legislative actions necessary to implement the
8787 state plan described in Subdivision (6):
8888 (A) consistent with the respective
8989 constitutional powers, rights, and responsibilities of the United
9090 States and of this state; and
9191 (B) necessary to protect the health, safety, and
9292 welfare of the residents of this state; and
9393 (8) to encourage a comprehensive, coordinated, and
9494 sustainable state response to issues related to immigration, advise
9595 the governor and the legislature on proposed legislation related to
9696 border security and illegal immigration on request of:
9797 (A) the governor;
9898 (B) the lieutenant governor;
9999 (C) the speaker of the house of representatives;
100100 (D) a member of the minority party in the senate
101101 chosen by the senators who are members of that party; or
102102 (E) a member of the minority party in the house of
103103 representatives chosen by the representatives who are members of
104104 that party.
105105 Sec. 330.102. STATE AGENCY INFORMATION. (a) The
106106 commission may request a state agency to provide to the commission
107107 available agency information the commission considers necessary to
108108 discharge the commission's duties under this chapter.
109109 (b) A state agency shall cooperate with the commission to
110110 provide the requested information under Subsection (a):
111111 (1) to the extent not inconsistent with law;
112112 (2) within the limits of the agency's statutory
113113 authority; and
114114 (3) timely as necessary to accomplish the purposes of
115115 this chapter.
116116 Sec. 330.103. TESTIMONY; EXPERT CONSULTANTS. (a) In
117117 performing its powers and duties, the commission may invite
118118 testimony from the governor, legislators, state agencies, and
119119 members of the public.
120120 (b) The commission may consult with experts or other
121121 knowledgeable public or private individuals on any matter related
122122 to the commission's powers and duties under this chapter.
123123 Sec. 330.104. PUBLIC HEARING. The commission may hold one
124124 or more public hearings the commission considers advisable and in
125125 locations in this state the commission selects to afford interested
126126 persons an opportunity to appear and present views on any subject
127127 relating to the commission's powers and duties under this chapter.
128128 Sec. 330.105. REPORT. (a) The commission annually shall
129129 report to the legislature and governor on commission activities and
130130 recommendations.
131131 (a-1) The commission shall submit an initial report to the
132132 legislature and governor not later than six months after the date of
133133 the first commission meeting. The commission shall submit its
134134 first annual report to the legislature and governor not later than
135135 six months after the date the initial report is submitted, or as
136136 soon as practicable after that date. This subsection expires
137137 January 1, 2028.
138138 (b) The commission on request shall provide to members of
139139 the public any report submitted under this section.
140140 SECTION 2. This Act takes effect September 1, 2025.
