77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a study on food deserts and their disproportionate
1010 impact among communities of color.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. (a) In this section:
1313 (1) "Department" means the Department of State Health
1414 Services.
1515 (2) "Food desert" means a geographic area in this
1616 state the department determines is an area with limited access to
1717 healthy and nutritious food.
1818 (b) The department, in collaboration with any appropriate
1919 state agency, shall conduct a study on food deserts and any
2020 disproportionate impact food deserts have on communities of color.
2121 In conducting the study, the department shall:
2222 (1) investigate the causes of food deserts;
2323 (2) investigate the health effects of food deserts;
2424 (3) investigate the financial impact of food deserts;
2525 (4) compare access to healthy and nutritious food
2626 related to an individual's:
2727 (A) age;
2828 (B) race and ethnicity; and
2929 (C) socioeconomic background; and
3030 (5) investigate the origins of any disproportionate
3131 impact food deserts have on communities of color.
3232 (c) Based on the results of the study conducted under this
3333 section, the department shall develop recommendations for
3434 legislative and other action to:
3535 (1) address disparities in food access among
3636 communities of color; and
3737 (2) increase access to healthy and nutritious food.
3838 (d) Not later than September 1, 2026, the department shall
3939 prepare and submit to each standing committee of the legislature
4040 with primary jurisdiction over the Department of State Health
4141 Services a written report summarizing the results of the study and
4242 including the recommendations developed under this section.
4343 (e) This Act expires September 1, 2027.
4444 SECTION 2. This Act takes effect September 1, 2025.
