66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to diversity, equity, and inclusion initiatives at public
99 institutions of higher education.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Sections 51.3525(c)-(j), Education Code, are
1212 amended to read as follows:
1313 (c) Nothing in this section may be construed to limit or
1414 prohibit an institution of higher education or an employee of an
1515 institution of higher education from, for purposes of applying for
1616 a grant or complying with the terms of accreditation by an
1717 accrediting agency, submitting to the grantor or accrediting agency
1818 a statement that:
1919 (1) highlights the institution's work in supporting:
2020 (A) first-generation college students;
2121 (B) low-income students; or
2222 (C) underserved student populations; or
2323 (2) certifies compliance with state and federal
2424 antidiscrimination laws.
2525 (d) Subsection (b)(1) may not be construed to apply to:
2626 (1) academic course instruction;
2727 (2) scholarly research or a creative work by an
2828 institution of higher education's students, faculty, or other
2929 research personnel or the dissemination of that research or work;
3030 (3) an activity of a student organization registered
3131 with or recognized by an institution of higher education;
3232 (4) guest speakers or performers on short-term
3333 engagements;
3434 (5) a policy, practice, procedure, program, or
3535 activity to enhance student academic achievement or postgraduate
3636 outcomes that is designed and implemented without regard to race,
3737 sex, color, or ethnicity;
3838 (6) data collection; or
3939 (7) student recruitment or admissions.
4040 (e c) An institution of higher education may not spend money
4141 appropriated to the institution for a state fiscal year until the
4242 governing board of the institution submits to the legislature and
4343 the Texas Higher Education Coordinating Board a report certifying
4444 the board's compliance with this section during the preceding state
4545 fiscal year.
4646 (fd) In the interim between each regular session of the
4747 legislature, the governing board of each institution of higher
4848 education, or the board's designee, shall testify before the
4949 standing legislative committees with primary jurisdiction over
5050 higher education at a public hearing of the committee regarding the
5151 board's compliance with this section.
5252 (ge) The state auditor shall periodically conduct a
5353 compliance audit of each institution of higher education to
5454 determine whether the institution has spent state money in
5555 violation of this section. The state auditor shall adopt a schedule
5656 by which the state auditor will conduct compliance audits under
5757 this subsection. The schedule must ensure that each institution of
5858 higher education is audited at least once every four years.
5959 (hf) If the state auditor determines pursuant to a
6060 compliance audit conducted under Subsection (ge) that an
6161 institution of higher education has spent state money in violation
6262 of this section, the institution:
6363 (1) must cure the violation not later than the 180th
6464 day after the date on which the determination is made; and
6565 (2) if the institution fails to cure the violation
6666 during the period described by Subdivision (1), is ineligible to
6767 receive formula funding increases, institutional enhancements, or
6868 exceptional items during the state fiscal biennium immediately
6969 following the state fiscal biennium in which the determination is
7070 made.
7171 (Ig) A student or employee of an institution of higher
7272 education who is required to participate in training in violation
7373 of Subsection (b)(1)(E) may bring an action against the institution
7474 for injunctive or declaratory relief.
7575 (jh) The Texas Higher Education Coordinating Board, in
7676 coordination with institutions of higher education, shall conduct a
7777 biennial study to identify the impact of the implementation of this
7878 section on the application rate, acceptance rate, matriculation
7979 rate, retention rate, grade point average, and graduation rate of
8080 students at institutions of higher education, disaggregated by
8181 race, sex, and ethnicity. Not later than December 1 of each
8282 even-numbered year, the coordinating board shall submit to the
8383 legislature a report on the results of the study and any
8484 recommendations for legislative or other action. This subsection
8585 expires September 1, 2029.
8686 SECTION 2. This Act takes effect immediately if it receives
8787 a vote of two-thirds of all the members elected to each house, as
8888 provided by Section 39, Article III, Texas Constitution. If this
8989 Act does not receive the vote necessary for immediate effect, this
9090 Act takes effect September 1, 2025.
