12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
13 | 13 | SECTION 1. Section 247.029(b), Health and Safety Code, is | |
14 | 14 | amended to read as follows: | |
15 | 15 | (b) The executive commissioner shall adopt minimum | |
16 | 16 | standards for an assisted living facility classified under this | |
17 | 17 | section. The minimum standards must require the facility to | |
18 | 18 | maintain an adequate ratio of direct care staff to residents based | |
19 | 19 | on: | |
20 | 20 | (1) scientific evidence; and | |
21 | 21 | (2) consideration of the increased need for | |
22 | 22 | supervision of residents with Alzheimer's disease or related | |
23 | 23 | disorders. | |
24 | 24 | SECTION 2. As soon as practicable after the effective date | |
25 | 25 | of this Act, the executive commissioner of the Health and Human | |
26 | 26 | Services Commission shall adopt the minimum standards necessary to | |
27 | 27 | implement the change in law made by this Act. | |
28 | 28 | SECTION 3. This Act takes effect September 1, 2025. |
