77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the establishment of a statewide dangerous dog
1010 registry.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter Z, Chapter 411, Government Code, is
1313 amended by adding Section 411.952 to read as follows:
1414 Sec. 411.952. STATEWIDE DANGEROUS DOG REGISTRY. (a) In
1515 this section, "animal control authority" has the meaning assigned
1616 by Section 822.041, Health and Safety Code.
1717 (b) This section applies only to an animal control authority
1818 located in a municipality with a population of more than 100,000.
1919 (c) The department, in collaboration with animal control
2020 authorities, shall establish and maintain on the department's
2121 Internet website a publicly accessible and searchable statewide
2222 registry for dogs an animal control authority determines are
2323 dangerous under Section 822.0421, Health and Safety Code.
2424 (d) The statewide registry must include for each dangerous
2525 dog listed in the registry the following information provided by an
2626 animal control authority:
2727 (1) proof of the dangerous dog's rabies vaccination;
2828 (2) proof the dangerous dog is kept in a secure
2929 enclosure;
3030 (3) proof the dangerous dog's owner obtained the
3131 liability insurance or financial responsibility required by
3232 Section 822.042, Health and Safety Code;
3333 (4) information on whether the dangerous dog has a
3434 permanent identification marker or tag, including a tattoo or
3535 microchip;
3636 (5) information on whether the dangerous dog is spayed
3737 or neutered;
3838 (6) the name of the dangerous dog;
3939 (7) a photograph of the dangerous dog;
4040 (8) the county in which the dangerous dog is located;
4141 and
4242 (9) the name of the current owner of the dangerous dog
4343 and the address at which the dangerous dog is housed.
4444 (e) On written approval of the municipality in which an
4545 animal control authority operates, the animal control authority may
4646 omit some or all of the information required under Subsection (d).
4747 (f) The commission shall adopt rules necessary to implement
4848 this section.
4949 SECTION 2. Section 822.0421, Health and Safety Code, is
5050 amended by adding Subsection (e) to read as follows:
5151 (e) On an animal control authority's determination that a
5252 dog is a dangerous dog or on the conclusion of an appeal upholding
5353 that determination, an animal control authority to which Section
5454 411.952, Government Code, applies shall provide to the Department
5555 of Public Safety the information required by that section for
5656 inclusion in the department's statewide dangerous dog registry,
5757 unless the municipality in which the animal control authority
5858 operates provides written approval for the animal control authority
5959 to omit some or all of the information.
6060 SECTION 3. Section 822.043, Health and Safety Code, is
6161 amended by adding Subsection (c-1) to read as follows:
6262 (c-1) On receiving notice an owner sold or moved a dangerous
6363 dog to another address, an animal control authority to which
6464 Section 411.952, Government Code, applies shall provide the address
6565 information to the Department of Public Safety for inclusion in the
6666 department's statewide dangerous dog registry under that section
6767 unless the municipality in which the animal control authority
6868 operates provides written approval for the animal control authority
6969 to omit some or all of the required information.
7070 SECTION 4. As soon as practicable after the effective date
7171 of this Act, the Department of Public Safety shall establish the
7272 statewide dangerous dog registry as required by Section 411.952,
7373 Government Code, as added by this Act.
7474 SECTION 5. This Act takes effect September 1, 2025.
