9 | 9 | | relating to the establishment of a statewide dangerous dog |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter Z, Chapter 411, Government Code, is |
---|
13 | 13 | | amended by adding Section 411.952 to read as follows: |
---|
14 | 14 | | Sec. 411.952. STATEWIDE DANGEROUS DOG REGISTRY. (a) In |
---|
15 | 15 | | this section, "animal control authority" has the meaning assigned |
---|
16 | 16 | | by Section 822.041, Health and Safety Code. |
---|
17 | 17 | | (b) This section applies only to an animal control authority |
---|
18 | 18 | | located in a municipality with a population of more than 100,000. |
---|
19 | 19 | | (c) The department, in collaboration with animal control |
---|
20 | 20 | | authorities, shall establish and maintain on the department's |
---|
21 | 21 | | Internet website a publicly accessible and searchable statewide |
---|
22 | 22 | | registry for dogs an animal control authority determines are |
---|
23 | 23 | | dangerous under Section 822.0421, Health and Safety Code. |
---|
24 | 24 | | (d) The statewide registry must include for each dangerous |
---|
25 | 25 | | dog listed in the registry the following information provided by an |
---|
26 | 26 | | animal control authority: |
---|
27 | 27 | | (1) proof of the dangerous dog's rabies vaccination; |
---|
28 | 28 | | (2) proof the dangerous dog is kept in a secure |
---|
29 | 29 | | enclosure; |
---|
30 | 30 | | (3) proof the dangerous dog's owner obtained the |
---|
31 | 31 | | liability insurance or financial responsibility required by |
---|
32 | 32 | | Section 822.042, Health and Safety Code; |
---|
33 | 33 | | (4) information on whether the dangerous dog has a |
---|
34 | 34 | | permanent identification marker or tag, including a tattoo or |
---|
35 | 35 | | microchip; |
---|
36 | 36 | | (5) information on whether the dangerous dog is spayed |
---|
37 | 37 | | or neutered; |
---|
38 | 38 | | (6) the name of the dangerous dog; |
---|
39 | 39 | | (7) a photograph of the dangerous dog; |
---|
40 | 40 | | (8) the county in which the dangerous dog is located; |
---|
41 | 41 | | and |
---|
42 | 42 | | (9) the name of the current owner of the dangerous dog |
---|
43 | 43 | | and the address at which the dangerous dog is housed. |
---|
44 | 44 | | (e) On written approval of the municipality in which an |
---|
45 | 45 | | animal control authority operates, the animal control authority may |
---|
46 | 46 | | omit some or all of the information required under Subsection (d). |
---|
47 | 47 | | (f) The commission shall adopt rules necessary to implement |
---|
48 | 48 | | this section. |
---|
49 | 49 | | SECTION 2. Section 822.0421, Health and Safety Code, is |
---|
50 | 50 | | amended by adding Subsection (e) to read as follows: |
---|
51 | 51 | | (e) On an animal control authority's determination that a |
---|
52 | 52 | | dog is a dangerous dog or on the conclusion of an appeal upholding |
---|
53 | 53 | | that determination, an animal control authority to which Section |
---|
54 | 54 | | 411.952, Government Code, applies shall provide to the Department |
---|
55 | 55 | | of Public Safety the information required by that section for |
---|
56 | 56 | | inclusion in the department's statewide dangerous dog registry, |
---|
57 | 57 | | unless the municipality in which the animal control authority |
---|
58 | 58 | | operates provides written approval for the animal control authority |
---|
59 | 59 | | to omit some or all of the information. |
---|
60 | 60 | | SECTION 3. Section 822.043, Health and Safety Code, is |
---|
61 | 61 | | amended by adding Subsection (c-1) to read as follows: |
---|
62 | 62 | | (c-1) On receiving notice an owner sold or moved a dangerous |
---|
63 | 63 | | dog to another address, an animal control authority to which |
---|
64 | 64 | | Section 411.952, Government Code, applies shall provide the address |
---|
65 | 65 | | information to the Department of Public Safety for inclusion in the |
---|
66 | 66 | | department's statewide dangerous dog registry under that section |
---|
67 | 67 | | unless the municipality in which the animal control authority |
---|
68 | 68 | | operates provides written approval for the animal control authority |
---|
69 | 69 | | to omit some or all of the required information. |
---|
70 | 70 | | SECTION 4. As soon as practicable after the effective date |
---|
71 | 71 | | of this Act, the Department of Public Safety shall establish the |
---|
72 | 72 | | statewide dangerous dog registry as required by Section 411.952, |
---|
73 | 73 | | Government Code, as added by this Act. |
---|
74 | 74 | | SECTION 5. This Act takes effect September 1, 2025. |
---|
