8	8	AN ACT
9	9	relating to the appearance of a personal identification certificate
10	10	or driver's license issued to a person who is a citizen of the
11	11	United States and to the use of the certificate or license in
12	12	certain election processes in this state.
13	13	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
14	14	SECTION 1. Section 13.002(c), Election Code, is amended to
15	15	read as follows:
16	16	(c) A registration application must include:
17	17	(1) the applicant's first name, middle name, if any,
18	18	last name, and former name, if any;
19	19	(2) the month, day, and year of the applicant's birth;
20	20	(3) a statement that the applicant is a United States
21	21	citizen;
22	22	(4) a statement that the applicant is a resident of the
23	23	county;
24	24	(5) a statement that the applicant has not been
25	25	determined by a final judgment of a court exercising probate
26	26	jurisdiction to be:
27	27	(A) totally mentally incapacitated; or
28	28	(B) partially mentally incapacitated without the
29	29	right to vote;
30	30	(6) a statement that the applicant has not been
31	31	finally convicted of a felony or that the applicant is a felon
32	32	eligible for registration under Section 13.001;
33	33	(7) the applicant's residence address or, if the
34	34	residence has no address, the address at which the applicant
35	35	receives mail and a concise description of the location of the
36	36	applicant's residence;
37	37	(8) the following information:
38	38	(A) the number of a [applicant's] Texas driver's
39	39	license [number] or [the number of a] personal identification card
40	40	issued to the applicant by the Department of Public Safety and
41	41	displaying the "CERTIFIED TEXAN" designator;
42	42	(B) if the applicant has not been issued a number
43	43	described by Paragraph (A), the last four digits of the applicant's
44	44	social security number; or
45	45	(C) a statement by the applicant that the
46	46	applicant has not been issued a number described by Paragraph (A) or
47	47	(B);
48	48	(9) if the application is made by an agent, a statement
49	49	of the agent's relationship to the applicant; and
50	50	(10) the city and county in which the applicant
51	51	formerly resided.
52	52	SECTION 2. Section 13.072(a), Election Code, is amended to
53	53	read as follows:
54	54	(a) Unless the registrar challenges the applicant, the
55	55	registrar shall approve the application if:
56	56	(1) the registrar determines that an application
57	57	complies with Section 13.002 and indicates that the applicant is
58	58	eligible for registration; and
59	59	(2) for an applicant who has not included a statement
60	60	described by Section 13.002(c)(8)(C), the registrar verifies with
61	61	the secretary of state:
62	62	(A) that the [applicant's] Texas driver's license
63	63	number or number of a personal identification card provided by the
64	64	applicant corresponds to a license or card issued to the applicant
65	65	by the Department of Public Safety and displays the "CERTIFIED
66	66	TEXAN" designator; or
67	67	(B) the last four digits of the applicant's
68	68	social security number.
69	69	SECTION 3. Section 63.0101(a), Election Code, is amended to
70	70	read as follows:
71	71	(a) The following documentation is an acceptable form of
72	72	photo identification under this chapter:
73	73	(1) a driver's license, election identification
74	74	certificate, or personal identification card issued to the person
75	75	by the Department of Public Safety that:
76	76	(A) displays the "CERTIFIED TEXAN" designator;
77	77	and
78	78	(B) has not expired or that expired no earlier
79	79	than four years before the date of presentation;
80	80	(2) [a United States military identification card that
81	81	contains the person's photograph that has not expired or that
82	82	expired no earlier than four years before the date of presentation;
83	83	[(3)] a United States citizenship certificate issued
84	84	to the person that contains the person's photograph;
85	85	(3) [(4)] a United States passport book or card issued
86	86	to the person that has not expired or that expired no earlier than
87	87	four years before the date of presentation; or
88	88	(4) [(5)] a license to carry a handgun issued to the
89	89	person by the Department of Public Safety that has not expired or
90	90	that expired no earlier than four years before the date of
91	91	presentation.
92	92	SECTION 4. Section 84.002(a), Election Code, is amended to
93	93	read as follows:
94	94	(a) An early voting ballot application must include:
95	95	(1) the applicant's name and the address at which the
96	96	applicant is registered to vote;
97	97	(1-a) the following information:
98	98	(A) the number of a [the applicant's] driver's
99	99	license or personal identification card issued to the applicant by
100	100	the Department of Public Safety and displaying the "CERTIFIED
101	101	TEXAN" designator or of an [,] election identification certificate
102	102	[, or personal identification card] issued to the applicant by the
103	103	Department of Public Safety;
104	104	(B) if the applicant has not been issued a number
105	105	described by Paragraph (A), the last four digits of the applicant's
106	106	social security number; or
107	107	(C) a statement by the applicant that the
108	108	applicant has not been issued a number described by Paragraph (A) or
109	109	(B);
110	110	(2) for an application for a ballot to be voted by mail
111	111	on the ground of absence from the county of residence, the address
112	112	outside the applicant's county of residence to which the ballot is
113	113	to be mailed;
114	114	(3) for an application for a ballot to be voted by mail
115	115	on the ground of age or disability, the address of the hospital,
116	116	nursing home or other long-term care facility, or retirement
117	117	center, or of a person related to the applicant within the second
118	118	degree by affinity or the third degree by consanguinity, as
119	119	determined under Chapter 573, Government Code, if the applicant is
120	120	living at that address and that address is different from the
121	121	address at which the applicant is registered to vote;
122	122	(4) for an application for a ballot to be voted by mail
123	123	on the ground of confinement in jail, the address of the jail or of a
124	124	person related to the applicant within the degree described by
125	125	Subdivision (3);
126	126	(5) for an application for a ballot to be voted by mail
127	127	on any ground, an indication of each election for which the
128	128	applicant is applying for a ballot;
129	129	(6) an indication of the ground of eligibility for
130	130	early voting; and
131	131	(7) for an application for a ballot to be voted by mail
132	132	on the ground of involuntary civil commitment, the address of the
133	133	facility operated by or under contract with the Texas Civil
134	134	Commitment Office or of a person related to the applicant within the
135	135	degree of consanguinity described by Subdivision (3).
136	136	SECTION 5. Subchapter E, Chapter 521, Transportation Code,
137	137	is amended by adding Section 521.1017 to read as follows:
138	138	Sec. 521.1017. CERTIFIED TEXAN DESIGNATOR. If, at the time
139	139	a person applies for a personal identification certificate, the
140	140	person provides a copy of a birth certificate issued for the person
141	141	within the United States, a Certificate of United States
142	142	Citizenship, a Certificate of Naturalization, a United States
143	143	Citizen Identification Card, or another document denoting the
144	144	person is a United States citizen issued by the federal Department
145	145	of Homeland Security or the United States Department of State that
146	146	includes an identification photograph, the personal identification
147	147	certificate issued to the person must display a large designator
148	148	with a stamp-like appearance reading "CERTIFIED TEXAN".
149	149	SECTION 6. Subchapter F, Chapter 521, Transportation Code,
150	150	is amended by adding Section 521.1225 to read as follows:
151	151	Sec. 521.1225. CERTIFIED TEXAN DESIGNATOR. If, at the time
152	152	a person applies for a driver's license, the person provides a copy
153	153	of a birth certificate issued for the person within the United
154	154	States, a Certificate of United States Citizenship, a Certificate
155	155	of Naturalization, a United States Citizen Identification Card, or
156	156	another document denoting the person is a United States citizen
157	157	issued by the federal Department of Homeland Security or the United
158	158	States Department of State that includes an identification
159	159	photograph, the driver's license issued to the person must display
160	160	a large designator with a stamp-like appearance reading "CERTIFIED
161	161	TEXAN".
162	162	SECTION 7. The changes in law made by this Act to Sections
163	163	13.002, 13.072, 63.0101, and 84.002, Election Code, and Subchapters
164	164	E and F, Chapter 521, Transportation Code, apply only to a personal
165	165	identification certificate or driver's license issued or renewed on
166	166	or after the effective date of this Act. A personal identification
167	167	certificate or driver's license issued or renewed before the
168	168	effective date of this Act is governed by the law in effect when the
169	169	certificate or license was issued or renewed, and the former law is
170	170	continued in effect for that purpose.
171	171	SECTION 8. This Act takes effect September 1, 2025.
