77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the appearance of a personal identification certificate
1010 or driver's license issued to a person who is a citizen of the
1111 United States and to the use of the certificate or license in
1212 certain election processes in this state.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 13.002(c), Election Code, is amended to
1515 read as follows:
1616 (c) A registration application must include:
1717 (1) the applicant's first name, middle name, if any,
1818 last name, and former name, if any;
1919 (2) the month, day, and year of the applicant's birth;
2020 (3) a statement that the applicant is a United States
2121 citizen;
2222 (4) a statement that the applicant is a resident of the
2323 county;
2424 (5) a statement that the applicant has not been
2525 determined by a final judgment of a court exercising probate
2626 jurisdiction to be:
2727 (A) totally mentally incapacitated; or
2828 (B) partially mentally incapacitated without the
2929 right to vote;
3030 (6) a statement that the applicant has not been
3131 finally convicted of a felony or that the applicant is a felon
3232 eligible for registration under Section 13.001;
3333 (7) the applicant's residence address or, if the
3434 residence has no address, the address at which the applicant
3535 receives mail and a concise description of the location of the
3636 applicant's residence;
3737 (8) the following information:
3838 (A) the number of a [applicant's] Texas driver's
3939 license [number] or [the number of a] personal identification card
4040 issued to the applicant by the Department of Public Safety and
4141 displaying the "CERTIFIED TEXAN" designator;
4242 (B) if the applicant has not been issued a number
4343 described by Paragraph (A), the last four digits of the applicant's
4444 social security number; or
4545 (C) a statement by the applicant that the
4646 applicant has not been issued a number described by Paragraph (A) or
4747 (B);
4848 (9) if the application is made by an agent, a statement
4949 of the agent's relationship to the applicant; and
5050 (10) the city and county in which the applicant
5151 formerly resided.
5252 SECTION 2. Section 13.072(a), Election Code, is amended to
5353 read as follows:
5454 (a) Unless the registrar challenges the applicant, the
5555 registrar shall approve the application if:
5656 (1) the registrar determines that an application
5757 complies with Section 13.002 and indicates that the applicant is
5858 eligible for registration; and
5959 (2) for an applicant who has not included a statement
6060 described by Section 13.002(c)(8)(C), the registrar verifies with
6161 the secretary of state:
6262 (A) that the [applicant's] Texas driver's license
6363 number or number of a personal identification card provided by the
6464 applicant corresponds to a license or card issued to the applicant
6565 by the Department of Public Safety and displays the "CERTIFIED
6666 TEXAN" designator; or
6767 (B) the last four digits of the applicant's
6868 social security number.
6969 SECTION 3. Section 63.0101(a), Election Code, is amended to
7070 read as follows:
7171 (a) The following documentation is an acceptable form of
7272 photo identification under this chapter:
7373 (1) a driver's license, election identification
7474 certificate, or personal identification card issued to the person
7575 by the Department of Public Safety that:
7676 (A) displays the "CERTIFIED TEXAN" designator;
7777 and
7878 (B) has not expired or that expired no earlier
7979 than four years before the date of presentation;
8080 (2) [a United States military identification card that
8181 contains the person's photograph that has not expired or that
8282 expired no earlier than four years before the date of presentation;
8383 [(3)] a United States citizenship certificate issued
8484 to the person that contains the person's photograph;
8585 (3) [(4)] a United States passport book or card issued
8686 to the person that has not expired or that expired no earlier than
8787 four years before the date of presentation; or
8888 (4) [(5)] a license to carry a handgun issued to the
8989 person by the Department of Public Safety that has not expired or
9090 that expired no earlier than four years before the date of
9191 presentation.
9292 SECTION 4. Section 84.002(a), Election Code, is amended to
9393 read as follows:
9494 (a) An early voting ballot application must include:
9595 (1) the applicant's name and the address at which the
9696 applicant is registered to vote;
9797 (1-a) the following information:
9898 (A) the number of a [the applicant's] driver's
9999 license or personal identification card issued to the applicant by
100100 the Department of Public Safety and displaying the "CERTIFIED
101101 TEXAN" designator or of an [,] election identification certificate
102102 [, or personal identification card] issued to the applicant by the
103103 Department of Public Safety;
104104 (B) if the applicant has not been issued a number
105105 described by Paragraph (A), the last four digits of the applicant's
106106 social security number; or
107107 (C) a statement by the applicant that the
108108 applicant has not been issued a number described by Paragraph (A) or
109109 (B);
110110 (2) for an application for a ballot to be voted by mail
111111 on the ground of absence from the county of residence, the address
112112 outside the applicant's county of residence to which the ballot is
113113 to be mailed;
114114 (3) for an application for a ballot to be voted by mail
115115 on the ground of age or disability, the address of the hospital,
116116 nursing home or other long-term care facility, or retirement
117117 center, or of a person related to the applicant within the second
118118 degree by affinity or the third degree by consanguinity, as
119119 determined under Chapter 573, Government Code, if the applicant is
120120 living at that address and that address is different from the
121121 address at which the applicant is registered to vote;
122122 (4) for an application for a ballot to be voted by mail
123123 on the ground of confinement in jail, the address of the jail or of a
124124 person related to the applicant within the degree described by
125125 Subdivision (3);
126126 (5) for an application for a ballot to be voted by mail
127127 on any ground, an indication of each election for which the
128128 applicant is applying for a ballot;
129129 (6) an indication of the ground of eligibility for
130130 early voting; and
131131 (7) for an application for a ballot to be voted by mail
132132 on the ground of involuntary civil commitment, the address of the
133133 facility operated by or under contract with the Texas Civil
134134 Commitment Office or of a person related to the applicant within the
135135 degree of consanguinity described by Subdivision (3).
136136 SECTION 5. Subchapter E, Chapter 521, Transportation Code,
137137 is amended by adding Section 521.1017 to read as follows:
138138 Sec. 521.1017. CERTIFIED TEXAN DESIGNATOR. If, at the time
139139 a person applies for a personal identification certificate, the
140140 person provides a copy of a birth certificate issued for the person
141141 within the United States, a Certificate of United States
142142 Citizenship, a Certificate of Naturalization, a United States
143143 Citizen Identification Card, or another document denoting the
144144 person is a United States citizen issued by the federal Department
145145 of Homeland Security or the United States Department of State that
146146 includes an identification photograph, the personal identification
147147 certificate issued to the person must display a large designator
148148 with a stamp-like appearance reading "CERTIFIED TEXAN".
149149 SECTION 6. Subchapter F, Chapter 521, Transportation Code,
150150 is amended by adding Section 521.1225 to read as follows:
151151 Sec. 521.1225. CERTIFIED TEXAN DESIGNATOR. If, at the time
152152 a person applies for a driver's license, the person provides a copy
153153 of a birth certificate issued for the person within the United
154154 States, a Certificate of United States Citizenship, a Certificate
155155 of Naturalization, a United States Citizen Identification Card, or
156156 another document denoting the person is a United States citizen
157157 issued by the federal Department of Homeland Security or the United
158158 States Department of State that includes an identification
159159 photograph, the driver's license issued to the person must display
160160 a large designator with a stamp-like appearance reading "CERTIFIED
161161 TEXAN".
162162 SECTION 7. The changes in law made by this Act to Sections
163163 13.002, 13.072, 63.0101, and 84.002, Election Code, and Subchapters
164164 E and F, Chapter 521, Transportation Code, apply only to a personal
165165 identification certificate or driver's license issued or renewed on
166166 or after the effective date of this Act. A personal identification
167167 certificate or driver's license issued or renewed before the
168168 effective date of this Act is governed by the law in effect when the
169169 certificate or license was issued or renewed, and the former law is
170170 continued in effect for that purpose.
171171 SECTION 8. This Act takes effect September 1, 2025.
