77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to certain statutes of limitations for criminal offenses,
1010 including the statutes of limitations for felony offenses relating
1111 to an election conducted in this state.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Article 12.01, Code of Criminal Procedure, as
1414 amended by Chapters 93 (S.B. 1527), 118 (H.B. 467), 127 (H.B. 1207),
1515 422 (H.B. 1769), 520 (H.B. 3025), 689 (H.B. 1506), 704 (H.B. 2019),
1616 709 (H.B. 2190), 768 (H.B. 4595), 830 (H.B. 2187), 885 (H.B. 4635),
1717 and 1041 (S.B. 129), Acts of the 88th Legislature, Regular Session,
1818 2023, is reenacted and amended to read as follows:
1919 Art. 12.01. FELONIES. Except as provided in Articles
2020 12.015 and 12.03, felony indictments may be presented within these
2121 limits, and not afterward:
2222 (1) no limitation:
2323 (A) murder and manslaughter;
2424 (B) sexual assault under Section 22.011(a)(2),
2525 Penal Code, or aggravated sexual assault under Section
2626 22.021(a)(1)(B), Penal Code;
2727 (C) sexual assault, if:
2828 (i) during the investigation of the offense
2929 biological matter is collected and the matter:
3030 (a) has not yet been subjected to
3131 forensic DNA testing; or
3232 (b) has been subjected to forensic DNA
3333 testing and the testing results show that the matter does not match
3434 the victim or any other person whose identity is readily
3535 ascertained; or
3636 (ii) probable cause exists to believe that
3737 the defendant has committed the same or a similar sex offense
3838 against five or more victims;
3939 (D) continuous sexual abuse of young child or
4040 disabled individual under Section 21.02, Penal Code;
4141 (E) indecency with a child under Section 21.11,
4242 Penal Code;
4343 (F) an offense involving leaving the scene of a
4444 collision under Section 550.021, Transportation Code, if the
4545 collision resulted in the death of a person;
4646 (G) trafficking of persons under Section
4747 20A.02(a)(7) or (8), Penal Code;
4848 (H) continuous trafficking of persons under
4949 Section 20A.03, Penal Code;
5050 (I) compelling prostitution under Section
5151 43.05(a)(2) or (3), Penal Code; [or]
5252 (J) tampering with physical evidence under
5353 Section 37.09(a)(1) or (d)(1), Penal Code, if:
5454 (i) the evidence tampered with is a human
5555 corpse, as defined by that section; or
5656 (ii) the investigation of the offense shows
5757 that a reasonable person in the position of the defendant at the
5858 time of the commission of the offense would have cause to believe
5959 that the evidence tampered with is related to a criminal homicide
6060 under Chapter 19, Penal Code;
6161 (K) [(J)] interference with child custody under
6262 Section 25.03(a)(3), Penal Code; or
6363 (L) [(J)] burglary under Section 30.02, Penal
6464 Code, if:
6565 (i) the offense is punishable under
6666 Subsection (d) of that section because the defendant entered a
6767 habitation with the intent to commit an offense under Section
6868 22.011 or 22.021, Penal Code; and
6969 (ii) during the investigation of the
7070 offense biological matter is collected and the matter:
7171 (a) has not yet been subjected to
7272 forensic DNA testing; or
7373 (b) has been subjected to forensic DNA
7474 testing and the testing results show that the matter does not match
7575 the victim or any other person whose identity is readily
7676 ascertained;
7777 (2) ten years from the date of the commission of the
7878 offense:
7979 (A) theft of any estate, real, personal or mixed,
8080 by an executor, administrator, guardian or trustee, with intent to
8181 defraud any creditor, heir, legatee, ward, distributee,
8282 beneficiary or settlor of a trust interested in such estate;
8383 (B) theft by a public servant of government
8484 property over which the public servant exercises control in the
8585 public servant's official capacity;
8686 (C) forgery or the uttering, using, or passing of
8787 forged instruments;
8888 (D) injury to an elderly or disabled individual
8989 punishable as a felony of the first degree under Section 22.04,
9090 Penal Code;
9191 (E) sexual assault, except as provided by
9292 Subdivision (1) or (9) [(8)];
9393 (F) arson;
9494 (G) trafficking of persons under Section
9595 20A.02(a)(1), (2), (3), or (4), Penal Code; or
9696 (H) compelling prostitution under Section
9797 43.05(a)(1), Penal Code;
9898 (3) seven years from the date of the commission of the
9999 offense:
100100 (A) misapplication of fiduciary property or
101101 property of a financial institution;
102102 (B) fraudulent securing of document execution;
103103 (C) a felony violation under Chapter 162, Tax
104104 Code;
105105 (D) false statement to obtain property or credit
106106 under Section 32.32, Penal Code;
107107 (E) money laundering;
108108 (F) credit card or debit card abuse under Section
109109 32.31, Penal Code;
110110 (G) fraudulent use or possession of identifying
111111 information under Section 32.51, Penal Code;
112112 (H) exploitation of a child, elderly individual,
113113 or disabled individual under Section 32.53, Penal Code;
114114 (I) health care fraud under Section 35A.02, Penal
115115 Code;
116116 (J) bigamy under Section 25.01, Penal Code,
117117 except as provided by Subdivision (7); or
118118 (K) possession or promotion of child pornography
119119 under Section 43.26, Penal Code;
120120 (4) five years from the date of the commission of the
121121 offense:
122122 (A) theft or robbery;
123123 (B) except as provided by Subdivision (5),
124124 kidnapping;
125125 (C) [(B-1)] except as provided by Subdivision
126126 (1) or (5), burglary;
127127 (D) [(C)] injury to an elderly or disabled
128128 individual that is not punishable as a felony of the first degree
129129 under Section 22.04, Penal Code;
130130 (E) [(D)] abandoning or endangering an [a
131131 child,] elderly [individual,] or disabled individual;
132132 (F) [(E)] insurance fraud;
133133 (G) [(F)] assault under Section 22.01, Penal
134134 Code, if the assault was committed against a person whose
135135 relationship to or association with the defendant is described by
136136 Section 71.0021(b), 71.003, or 71.005, Family Code;
137137 (H) [(G)] continuous violence against the family
138138 under Section 25.11, Penal Code; [or]
139139 (I) [(H)] aggravated assault under Section
140140 22.02, Penal Code; or
141141 (J) a felony offense under the Election Code or
142142 otherwise related to an election conducted in this state;
143143 (5) if the investigation of the offense shows that the
144144 victim is younger than 17 years of age at the time the offense is
145145 committed, 20 years from the 18th birthday of the victim of one of
146146 the following offenses:
147147 (A) kidnapping under Section 20.03, Penal Code,
148148 or aggravated kidnapping under Section 20.04, Penal Code; or
149149 (B) subject to Subdivision (1)(L) [(1)(J)],
150150 burglary under Section 30.02, Penal Code, if the offense is
151151 punishable under Subsection (d) of that section because the
152152 defendant entered a habitation with the intent to commit an offense
153153 described by Subdivision (1)(B) or (D) of this article or Paragraph
154154 (A) of this subdivision;
155155 (6) 20 years from the 18th birthday of the victim of
156156 one of the following offenses:
157157 (A) trafficking of a child [persons] under
158158 Section 20A.02(a)(5) or (6), Penal Code; or
159159 (B) sexual performance by a child under Section
160160 43.25, Penal Code;
161161 (7) ten years from the 18th birthday of the victim of
162162 the offense:
163163 (A) injury to a child under Section 22.04, Penal
164164 Code;
165165 (B) bigamy under Section 25.01, Penal Code, if
166166 the investigation of the offense shows that the person, other than
167167 the legal spouse of the defendant, whom the defendant marries or
168168 purports to marry or with whom the defendant lives under the
169169 appearance of being married is younger than 18 years of age at the
170170 time the offense is committed; or
171171 (C) [(D)] abandoning or endangering a child;
172172 (8) [(7)] ten years from the date the offense was
173173 discovered: trafficking of a disabled individual under Section
174174 20A.02(a)(5) or (6), Penal Code;
175175 (9) [(8)] two years from the date the offense was
176176 discovered: sexual assault punishable as a state jail felony under
177177 Section 22.011(f)(2), Penal Code; or
178178 (10) [(9)] three years from the date of the commission
179179 of the offense: all other felonies.
180180 SECTION 2. The change in law made by this Act does not apply
181181 to an offense if the prosecution of that offense becomes barred by
182182 limitation before the effective date of this Act. The prosecution
183183 of that offense remains barred as if this Act had not taken effect.
184184 SECTION 3. This Act takes effect September 1, 2025.
