11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Subchapter A, Chapter 2001, Government Code, is | |
13 | 13 | amended by adding Section 2001.008 to read as follows: | |
14 | 14 | Sec. 2001.008. EFFECT OF AMENDMENT OF DOCUMENTS | |
15 | 15 | INCORPORATED BY REFERENCE ON CERTAIN RULES. A state agency in the | |
16 | 16 | manner provided by this chapter shall readopt, readopt with | |
17 | 17 | amendments, or repeal a previously adopted rule if: | |
18 | 18 | (1) the rule implements, interprets, or prescribes a | |
19 | 19 | law or policy of this state that incorporates by reference a | |
20 | 20 | document that is not another law or policy of this state; and | |
21 | 21 | (2) as a result of an amendment to the document that is | |
22 | 22 | incorporated by reference into the law or policy the rule | |
23 | 23 | implements, interprets, or prescribes, the rule would: | |
24 | 24 | (A) allow the agency to expand its regulatory | |
25 | 25 | authority over a matter that involves a question of state policy; or | |
26 | 26 | (B) impose a greater economic burden on persons | |
27 | 27 | required to comply with the rule or on the economy of this state. | |
28 | 28 | SECTION 2. This Act takes effect September 1, 2025. |
