118 relating to the adoption of a water conservation program by certain
129 counties.
1310 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1411 SECTION 1. Chapter 562, Local Government Code, is amended
1512 by adding Subchapter C to read as follows:
1613 SUBCHAPTER C. WATER CONSERVATION
1714 Sec. 562.051. WATER CONSERVATION PROGRAMS FOR CERTAIN
18- COUNTIES. (a) This section applies only to a county that has a
19- population greater than 230,000, is wholly or partly located within
20- the boundaries of the Hill Country Priority Groundwater Management
21- Area, and is adjacent to a county with a population greater than one
22- million.
15+ COUNTIES. (a) This section applies only to a county that contains,
16+ wholly or partly, a priority groundwater management area as
17+ designated under Section 35.007, Water Code.
2318 (b) The commissioners court of a county by order may adopt a
2419 water conservation program. Except as provided by Subsection (c),
2520 a water conservation program adopted under this section may
2621 establish for the unincorporated area of the county, including the
2722 extraterritorial jurisdiction of a municipality, water
2823 conservation standards applicable to a development, redevelopment,
2924 or subdivision of a tract of land that begins after August 31, 2025.
3025 (c) Water conservation standards established under
3126 Subsection (b) do not apply to an agricultural operation, as
3227 defined by Section 251.002, Agriculture Code.
3328 (d) To the extent of a conflict between a county order
34- adopted under this section and a permit, rule, ordinance, or other
35- measure issued by a governmental entity and regulating the same
36- conduct:
37- (1) if the governmental entity is a municipality, the
38- municipal measure prevails; or
39- (2) if the governmental entity is a political
40- subdivision other than a municipality, the more stringent
41- regulation prevails.
42- Sec. 562.052. EXPIRATION. This subchapter and any water
43- conservation programs adopted under Section 562.051 expire
44- September 1, 2031.
29+ adopted under this section and a municipal ordinance regulating the
30+ same conduct, the ordinance prevails.
4531 SECTION 2. This Act takes effect September 1, 2025.
