12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Subtitle A, Title 10, Business & Commerce Code, |
---|
14 | 14 | | is amended by adding Chapter 307 to read as follows: |
---|
15 | 15 | | CHAPTER 307. DISABLING STOLEN MOBILE DEVICES |
---|
16 | 16 | | Sec. 307.001. DEFINITIONS. In this chapter: |
---|
17 | 17 | | (1) "Authorized customer" means, with respect to a |
---|
18 | 18 | | mobile device: |
---|
19 | 19 | | (A) the person who holds the commercial wireless |
---|
20 | 20 | | telephone service account for the device; or |
---|
21 | 21 | | (B) if the device is a phone for which particular |
---|
22 | 22 | | amounts of service are purchased in advance, the person who owns the |
---|
23 | 23 | | phone. |
---|
24 | 24 | | (2) "Mobile device" means a handheld mobile device |
---|
25 | 25 | | that: |
---|
26 | 26 | | (A) is designed to enable the user to engage in |
---|
27 | 27 | | voice communications using a commercial wireless telephone |
---|
28 | 28 | | service; |
---|
29 | 29 | | (B) is capable of operating on a long-term |
---|
30 | 30 | | evolution network or successor wireless data network communication |
---|
31 | 31 | | standard; and |
---|
32 | 32 | | (C) may possess capabilities that include |
---|
33 | 33 | | built-in applications, Internet access, Internet browsing, digital |
---|
34 | 34 | | voice service, text messaging, and e-mail. |
---|
35 | 35 | | Sec. 307.002. DISABLING SERVICE TO STOLEN MOBILE DEVICES. |
---|
36 | 36 | | (a) A provider of wireless telephone services in this state may not |
---|
37 | 37 | | knowingly provide services on a mobile device that the provider |
---|
38 | 38 | | knows or has reason to believe is stolen. |
---|
39 | 39 | | (b) On receipt of notification from an authorized customer |
---|
40 | 40 | | that a mobile device has been stolen, a provider of wireless |
---|
41 | 41 | | telephone services shall suspend or otherwise cease providing |
---|
42 | 42 | | wireless telephone services to the device. |
---|
43 | 43 | | Sec. 307.003. DISABLING STOLEN MOBILE DEVICES. A |
---|
44 | 44 | | manufacturer of a mobile device to be sold in this state shall equip |
---|
45 | 45 | | the device or allow the device to be equipped with technology that |
---|
46 | 46 | | permits an authorized customer who reports the device stolen to |
---|
47 | 47 | | render the device inoperable. |
---|
48 | 48 | | SECTION 2. Section 307.003, Business & Commerce Code, as |
---|
49 | 49 | | added by this Act, applies only to a mobile device manufactured on |
---|
50 | 50 | | or after the effective date of this Act. |
---|
51 | 51 | | SECTION 3. This Act takes effect September 1, 2025. |
