77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to requiring wireless telephone service providers and
1010 mobile device manufacturers to disable certain stolen mobile
1111 devices.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subtitle A, Title 10, Business & Commerce Code,
1414 is amended by adding Chapter 307 to read as follows:
1515 CHAPTER 307. DISABLING STOLEN MOBILE DEVICES
1616 Sec. 307.001. DEFINITIONS. In this chapter:
1717 (1) "Authorized customer" means, with respect to a
1818 mobile device:
1919 (A) the person who holds the commercial wireless
2020 telephone service account for the device; or
2121 (B) if the device is a phone for which particular
2222 amounts of service are purchased in advance, the person who owns the
2323 phone.
2424 (2) "Mobile device" means a handheld mobile device
2525 that:
2626 (A) is designed to enable the user to engage in
2727 voice communications using a commercial wireless telephone
2828 service;
2929 (B) is capable of operating on a long-term
3030 evolution network or successor wireless data network communication
3131 standard; and
3232 (C) may possess capabilities that include
3333 built-in applications, Internet access, Internet browsing, digital
3434 voice service, text messaging, and e-mail.
3535 Sec. 307.002. DISABLING SERVICE TO STOLEN MOBILE DEVICES.
3636 (a) A provider of wireless telephone services in this state may not
3737 knowingly provide services on a mobile device that the provider
3838 knows or has reason to believe is stolen.
3939 (b) On receipt of notification from an authorized customer
4040 that a mobile device has been stolen, a provider of wireless
4141 telephone services shall suspend or otherwise cease providing
4242 wireless telephone services to the device.
4343 Sec. 307.003. DISABLING STOLEN MOBILE DEVICES. A
4444 manufacturer of a mobile device to be sold in this state shall equip
4545 the device or allow the device to be equipped with technology that
4646 permits an authorized customer who reports the device stolen to
4747 render the device inoperable.
4848 SECTION 2. Section 307.003, Business & Commerce Code, as
4949 added by this Act, applies only to a mobile device manufactured on
5050 or after the effective date of this Act.
5151 SECTION 3. This Act takes effect September 1, 2025.
