77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the applicability to election judges of a prohibition
1010 on the carrying of a concealed handgun at a polling place.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 46.15, Penal Code, is amended by adding
1313 Subsection (s) to read as follows:
1414 (s) Section 46.03(a)(2) does not apply to a person who
1515 carries a concealed handgun if the person:
1616 (1) is licensed to carry a handgun under Subchapter H,
1717 Chapter 411, Government Code; and
1818 (2) is engaged in the performance of the person's
1919 duties as:
2020 (A) an election judge under Chapter 32, Election
2121 Code; or
2222 (B) an early voting clerk or a deputy early
2323 voting clerk who is serving as an election judge at an early voting
2424 polling place under Chapter 83 or 85, Election Code.
2525 SECTION 2. The change in law made by this Act applies only
2626 to an offense committed on or after the effective date of this Act.
2727 An offense committed before the effective date of this Act is
2828 governed by the law in effect on the date the offense was committed,
2929 and the former law is continued in effect for that purpose. For
3030 purposes of this section, an offense was committed before the
3131 effective date of this Act if any element of the offense was
3232 committed before that date.
3333 SECTION 3. This Act takes effect September 1, 2025.
