| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 46.15, Penal Code, is amended by adding |
|---|
| 13 | 13 | | Subsection (s) to read as follows: |
|---|
| 14 | 14 | | (s) Section 46.03(a)(2) does not apply to a person who |
|---|
| 15 | 15 | | carries a concealed handgun if the person: |
|---|
| 16 | 16 | | (1) is licensed to carry a handgun under Subchapter H, |
|---|
| 17 | 17 | | Chapter 411, Government Code; and |
|---|
| 18 | 18 | | (2) is engaged in the performance of the person's |
|---|
| 19 | 19 | | duties as: |
|---|
| 20 | 20 | | (A) an election judge under Chapter 32, Election |
|---|
| 21 | 21 | | Code; or |
|---|
| 22 | 22 | | (B) an early voting clerk or a deputy early |
|---|
| 23 | 23 | | voting clerk who is serving as an election judge at an early voting |
|---|
| 24 | 24 | | polling place under Chapter 83 or 85, Election Code. |
|---|
| 25 | 25 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 26 | 26 | | to an offense committed on or after the effective date of this Act. |
|---|
| 27 | 27 | | An offense committed before the effective date of this Act is |
|---|
| 28 | 28 | | governed by the law in effect on the date the offense was committed, |
|---|
| 29 | 29 | | and the former law is continued in effect for that purpose. For |
|---|
| 30 | 30 | | purposes of this section, an offense was committed before the |
|---|
| 31 | 31 | | effective date of this Act if any element of the offense was |
|---|
| 32 | 32 | | committed before that date. |
|---|
| 33 | 33 | | SECTION 3. This Act takes effect September 1, 2025. |
