77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the requirements for facilities that provide care and
1010 services to persons with Alzheimer's disease and related disorders.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The heading to Section 242.040, Health and
1313 Safety Code, is amended to read as follows:
1414 Sec. 242.040. CERTIFICATION OF NURSING FACILITIES
1515 [INSTITUTIONS] THAT PROVIDE CARE AND TREATMENT FOR PERSONS WITH
1616 ALZHEIMER'S DISEASE AND RELATED DISORDERS.
1717 SECTION 2. Section 242.040, Health and Safety Code, is
1818 amended by amending Subsections (a), (b), (c), (e), and (f) and
1919 adding Subsections (b-1), (b-2), and (b-3) to read as follows:
2020 (a) The commission [department] shall establish a system
2121 for certifying nursing facilities [institutions] that meet
2222 standards adopted by the executive commissioner concerning the
2323 specialized care and treatment of persons with Alzheimer's disease
2424 and related disorders.
2525 (b) A nursing facility may [An institution is] not [required
2626 to be certified under this section in order to] provide care and
2727 treatment for [of] persons with Alzheimer's disease and related
2828 disorders unless the facility holds a certification issued under
2929 this section.
3030 (b-1) Notwithstanding Subsection (b) and subject to
3131 Subsection (b-2), a nursing facility is not required to hold a
3232 certification issued under this section to provide care and
3333 treatment for persons with Alzheimer's disease and related
3434 disorders before January 1, 2030.
3535 (b-2) A nursing facility initially licensed under this
3636 chapter on or after January 1, 2027, must hold a certification
3737 issued under this section to provide care and treatment for persons
3838 with Alzheimer's disease and related disorders.
3939 (b-3) Subsections (b-1) and (b-2) and this subsection
4040 expire September 1, 2032.
4141 (c) The executive commissioner by rule shall [may] adopt
4242 standards for the specialized care and treatment of persons with
4343 Alzheimer's disease and related disorders and provide procedures
4444 for nursing facilities [institutions] applying for certification
4545 under this section. The rules must provide for a three-year
4646 certification period.
4747 (e) A nursing facility [An institution] may not advertise or
4848 otherwise communicate that the facility [institution] is certified
4949 by the commission [department] to provide specialized care or
5050 treatment for persons with Alzheimer's disease or related disorders
5151 unless the facility [institution] is certified under this section.
5252 (f) The executive commissioner by rule shall adopt a system
5353 under which an appropriate number of certifications issued by the
5454 commission [department] expire on staggered dates occurring in each
5555 three-year period. If the expiration date of a certification
5656 changes as a result of this subsection, the commission [department]
5757 shall prorate the certification fee relating to that certification
5858 as appropriate.
5959 SECTION 3. The heading to Section 247.029, Health and
6060 Safety Code, is amended to read as follows:
6161 Sec. 247.029. CLASSIFICATION OF FACILITIES THAT PROVIDE
6262 PERSONAL CARE SERVICES TO [FOR] PERSONS WITH ALZHEIMER'S DISEASE OR
6363 RELATED DISORDERS.
6464 SECTION 4. Section 247.029, Health and Safety Code, is
6565 amended by amending Subsection (a) and adding Subsections (a-1),
6666 (a-2), and (a-3) to read as follows:
6767 (a) The executive commissioner by rule shall establish a
6868 classification and license for a facility that [advertises,
6969 markets, or otherwise promotes that the facility] provides personal
7070 care services to residents who have Alzheimer's disease or related
7171 disorders. A facility may not [is not required to be classified
7272 under this section to] provide personal care services [care or
7373 treatment] to residents who have Alzheimer's disease or related
7474 disorders unless the facility is classified under this section.
7575 (a-1) Notwithstanding Subsection (a) and subject to
7676 Subsection (a-2), a facility is not required to be classified under
7777 this section to provide personal care services to persons with
7878 Alzheimer's disease or related disorders before January 1, 2030.
7979 (a-2) A facility initially licensed under this chapter on or
8080 after January 1, 2027, must be classified under this section to
8181 provide personal care services to persons with Alzheimer's disease
8282 or related disorders.
8383 (a-3) Subsections (a-1) and (a-2) and this subsection
8484 expire September 1, 2032.
8585 SECTION 5. As soon as practicable after the effective date
8686 of this Act, the executive commissioner of the Health and Human
8787 Services Commission shall adopt the rules necessary to implement
8888 the changes in law made by this Act.
8989 SECTION 6. This Act takes effect September 1, 2025.
