77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to prohibiting the transfer of firearms to certain
1010 recipients.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 46.06, Penal Code, is amended by
1313 amending Subsections (a), (c), and (d) and adding Subsection (c-1)
1414 to read as follows:
1515 (a) A person commits an offense if the person:
1616 (1) sells, rents, leases, loans, or gives a handgun to
1717 any person knowing that the person to whom the handgun is to be
1818 delivered intends to use it unlawfully or in the commission of an
1919 unlawful act;
2020 (2) intentionally or knowingly sells, rents, leases,
2121 or gives or offers to sell, rent, lease, or give:
2222 (A) to a [any] child younger than 18 years of age
2323 a [any firearm,] club[,] or location-restricted knife; or
2424 (B) to a person younger than 21 years of age a
2525 firearm;
2626 (3) intentionally, knowingly, or recklessly sells a
2727 firearm or ammunition for a firearm to any person who is
2828 intoxicated;
2929 (4) knowingly sells a firearm or ammunition for a
3030 firearm to any person who has been convicted of a felony before the
3131 fifth anniversary of the later of the following dates:
3232 (A) the person's release from confinement
3333 following conviction of the felony; or
3434 (B) the person's release from supervision under
3535 community supervision, parole, or mandatory supervision following
3636 conviction of the felony;
3737 (5) sells, rents, leases, loans, or gives a handgun to
3838 any person knowing that an active protective order is directed to
3939 the person to whom the handgun is to be delivered;
4040 (6) knowingly purchases, rents, leases, or receives as
4141 a loan or gift from another a handgun while an active protective
4242 order is directed to the actor; or
4343 (7) while prohibited from possessing a firearm under
4444 state or federal law, knowingly makes a material false statement on
4545 a form that is:
4646 (A) required by state or federal law for the
4747 purchase, sale, or other transfer of a firearm; and
4848 (B) submitted to a firearms dealer licensed under
4949 18 U.S.C. Section 923.
5050 (c) It is an affirmative defense to prosecution under
5151 Subsection (a)(2)(A) [(a)(2)] that the transfer was to a minor
5252 whose parent or the person having legal custody of the minor had
5353 given written permission for the sale or, if the transfer was other
5454 than a sale, the parent or person having legal custody had given
5555 effective consent.
5656 (c-1) It is an exception to the application of Subsection
5757 (a)(2)(B) that the transfer of the firearm is necessary for the
5858 actual discharge of the recipient's official duties as a peace
5959 officer or a member of the United States armed forces or state
6060 military forces, as defined by Section 437.001, Government Code.
6161 (d) An offense under this section is a Class A misdemeanor,
6262 except that:
6363 (1) an offense under Subsection (a)(2)(B) [(a)(2)] is
6464 a state jail felony if the firearm [weapon] that is the subject of
6565 the offense is a handgun; and
6666 (2) an offense under Subsection (a)(7) is a state jail
6767 felony.
6868 SECTION 2. The change in law made by this Act applies only
6969 to an offense committed on or after the effective date of this Act.
7070 An offense committed before the effective date of this Act is
7171 governed by the law in effect on the date the offense was committed,
7272 and the former law is continued in effect for that purpose. For
7373 purposes of this section, an offense was committed before the
7474 effective date of this Act if any element of the offense occurred
7575 before that date.
7676 SECTION 3. This Act takes effect September 1, 2025.
