77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to county regulation of subdivisions and approval of
1010 subdivision plans or plats.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Sections 232.0015(c) and (f), Local Government
1313 Code, are amended to read as follows:
1414 (c) A county may not require the owner of a tract of land
1515 located outside the limits of a municipality who divides the tract
1616 into two or more parts to have a plat of the subdivision prepared
1717 if:
1818 (1) the owner does not lay out:
1919 (A) a part of the tract described by Section
2020 232.001(a)(3); or
2121 (B) one or more streets, alleys, squares, parks,
2222 or other parts of the tract intended for the use of purchasers or
2323 owners of lots fronting on or adjacent to the streets, alleys,
2424 squares, parks, or other parts; and
2525 (2) the land is to be used primarily for agricultural
2626 use, as defined by Section 1-d, Article VIII, Texas Constitution,
2727 or for farm, ranch, wildlife management, or timber production use
2828 within the meaning of Section 1-d-1, Article VIII, Texas
2929 Constitution.
3030 (f) A county may not require the owner of a tract of land
3131 located outside the limits of a municipality who divides the tract
3232 into two or more parts to have a plat of the subdivision prepared
3333 if:
3434 (1) all of the lots of the subdivision are more than 10
3535 acres in area; and
3636 (2) the owner does not lay out:
3737 (A) a part of the tract described by Section
3838 232.001(a)(3); or
3939 (B) one or more streets, alleys, squares, parks,
4040 or other parts of the tract intended for the use of purchasers or
4141 owners of lots fronting on or adjacent to the streets, alleys,
4242 squares, parks, or other parts.
4343 SECTION 2. Section 35.019(a), Water Code, is amended to
4444 read as follows:
4545 (a) Notwithstanding Section 232.001(h), Local Government
4646 Code, the [The] commissioners court of a county in a priority
4747 groundwater management area may adopt water availability
4848 requirements in an area where platting is required if the court
4949 determines that the requirements are necessary to prevent current
5050 or projected water use in the county from exceeding the safe
5151 sustainable yield of the county's water supply.
5252 SECTION 3. This Act takes effect September 1, 2025.
