| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Sections 232.0015(c) and (f), Local Government |
|---|
| 13 | 13 | | Code, are amended to read as follows: |
|---|
| 14 | 14 | | (c) A county may not require the owner of a tract of land |
|---|
| 15 | 15 | | located outside the limits of a municipality who divides the tract |
|---|
| 16 | 16 | | into two or more parts to have a plat of the subdivision prepared |
|---|
| 17 | 17 | | if: |
|---|
| 18 | 18 | | (1) the owner does not lay out: |
|---|
| 19 | 19 | | (A) a part of the tract described by Section |
|---|
| 20 | 20 | | 232.001(a)(3); or |
|---|
| 21 | 21 | | (B) one or more streets, alleys, squares, parks, |
|---|
| 22 | 22 | | or other parts of the tract intended for the use of purchasers or |
|---|
| 23 | 23 | | owners of lots fronting on or adjacent to the streets, alleys, |
|---|
| 24 | 24 | | squares, parks, or other parts; and |
|---|
| 25 | 25 | | (2) the land is to be used primarily for agricultural |
|---|
| 26 | 26 | | use, as defined by Section 1-d, Article VIII, Texas Constitution, |
|---|
| 27 | 27 | | or for farm, ranch, wildlife management, or timber production use |
|---|
| 28 | 28 | | within the meaning of Section 1-d-1, Article VIII, Texas |
|---|
| 29 | 29 | | Constitution. |
|---|
| 30 | 30 | | (f) A county may not require the owner of a tract of land |
|---|
| 31 | 31 | | located outside the limits of a municipality who divides the tract |
|---|
| 32 | 32 | | into two or more parts to have a plat of the subdivision prepared |
|---|
| 33 | 33 | | if: |
|---|
| 34 | 34 | | (1) all of the lots of the subdivision are more than 10 |
|---|
| 35 | 35 | | acres in area; and |
|---|
| 36 | 36 | | (2) the owner does not lay out: |
|---|
| 37 | 37 | | (A) a part of the tract described by Section |
|---|
| 38 | 38 | | 232.001(a)(3); or |
|---|
| 39 | 39 | | (B) one or more streets, alleys, squares, parks, |
|---|
| 40 | 40 | | or other parts of the tract intended for the use of purchasers or |
|---|
| 41 | 41 | | owners of lots fronting on or adjacent to the streets, alleys, |
|---|
| 42 | 42 | | squares, parks, or other parts. |

| 43 | 43 | | SECTION 2. Section 35.019(a), Water Code, is amended to |
|---|
| 44 | 44 | | read as follows: |
|---|
| 45 | 45 | | (a) Notwithstanding Section 232.001(h), Local Government |
|---|
| 46 | 46 | | Code, the [The] commissioners court of a county in a priority |
|---|
| 47 | 47 | | groundwater management area may adopt water availability |
|---|
| 48 | 48 | | requirements in an area where platting is required if the court |
|---|
| 49 | 49 | | determines that the requirements are necessary to prevent current |
|---|
| 50 | 50 | | or projected water use in the county from exceeding the safe |
|---|
| 51 | 51 | | sustainable yield of the county's water supply. |
|---|
| 52 | 52 | | SECTION 3. This Act takes effect September 1, 2025. |
