77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the procedure for determining whether a student's
1010 violation of a public school's or public institution of higher
1111 education's student code of conduct was motivated by antisemitism.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter A, Chapter 37, Education Code, is
1414 amended by adding Section 37.0095 to read as follows:
1515 Sec. 37.0095. ANTISEMITISM: DISCIPLINARY ACTION. In taking
1616 disciplinary action against a student for behavior that violates
1717 the student code of conduct adopted under Section 37.001 and that
1818 may reasonably be determined to have been motivated by
1919 antisemitism, a school district or open-enrollment charter school
2020 shall consider the definition of antisemitism provided by Section
2121 448.001, Government Code, including the examples referenced in that
2222 term, as instructive in determining whether the student's behavior
2323 was motivated by antisemitism.
2424 SECTION 2. Subchapter Z, Chapter 51, Education Code, is
2525 amended by adding Section 51.9791 to read as follows:
2626 Sec. 51.9791. ANTISEMITISM: DISCIPLINARY ACTION. (a) In
2727 this section, "institution of higher education" has the meaning
2828 assigned by Section 61.003.
2929 (b) In taking disciplinary action against a student for
3030 behavior that violates the institution's student code of conduct
3131 and that may reasonably be determined to have been motivated by
3232 antisemitism, an institution of higher education shall consider the
3333 definition of antisemitism provided by Section 448.001, Government
3434 Code, including the examples referenced in that term, as
3535 instructive in determining whether the student's behavior was
3636 motivated by antisemitism.
3737 SECTION 3. (a) Section 37.0095, Education Code, as added by
3838 this Act, applies beginning with the 2025-2026 school year.
3939 (b) Section 51.9791, Education Code, as added by this Act,
4040 applies beginning with the 2025-2026 academic year.
4141 SECTION 4. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all the members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2025.
