| 9 | 9 | | relating to the procedure for determining whether a student's |

| 10 | 10 | | violation of a public school's or public institution of higher |
|---|
| 11 | 11 | | education's student code of conduct was motivated by antisemitism. |

| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subchapter A, Chapter 37, Education Code, is |
|---|
| 14 | 14 | | amended by adding Section 37.0095 to read as follows: |
|---|
| 15 | 15 | | Sec. 37.0095. ANTISEMITISM: DISCIPLINARY ACTION. In taking |
|---|
| 16 | 16 | | disciplinary action against a student for behavior that violates |
|---|
| 17 | 17 | | the student code of conduct adopted under Section 37.001 and that |
|---|
| 18 | 18 | | may reasonably be determined to have been motivated by |
|---|
| 19 | 19 | | antisemitism, a school district or open-enrollment charter school |
|---|
| 20 | 20 | | shall consider the definition of antisemitism provided by Section |
|---|
| 21 | 21 | | 448.001, Government Code, including the examples referenced in that |
|---|
| 22 | 22 | | term, as instructive in determining whether the student's behavior |
|---|
| 23 | 23 | | was motivated by antisemitism. |
|---|
| 24 | 24 | | SECTION 2. Subchapter Z, Chapter 51, Education Code, is |
|---|
| 25 | 25 | | amended by adding Section 51.9791 to read as follows: |
|---|
| 26 | 26 | | Sec. 51.9791. ANTISEMITISM: DISCIPLINARY ACTION. (a) In |
|---|
| 27 | 27 | | this section, "institution of higher education" has the meaning |
|---|
| 28 | 28 | | assigned by Section 61.003. |
|---|
| 29 | 29 | | (b) In taking disciplinary action against a student for |
|---|
| 30 | 30 | | behavior that violates the institution's student code of conduct |
|---|
| 31 | 31 | | and that may reasonably be determined to have been motivated by |
|---|
| 32 | 32 | | antisemitism, an institution of higher education shall consider the |
|---|
| 33 | 33 | | definition of antisemitism provided by Section 448.001, Government |
|---|
| 34 | 34 | | Code, including the examples referenced in that term, as |
|---|
| 35 | 35 | | instructive in determining whether the student's behavior was |
|---|
| 36 | 36 | | motivated by antisemitism. |
|---|
| 37 | 37 | | SECTION 3. (a) Section 37.0095, Education Code, as added by |
|---|
| 38 | 38 | | this Act, applies beginning with the 2025-2026 school year. |
|---|
| 39 | 39 | | (b) Section 51.9791, Education Code, as added by this Act, |
|---|
| 40 | 40 | | applies beginning with the 2025-2026 academic year. |
|---|
| 41 | 41 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 42 | 42 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 43 | 43 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 44 | 44 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 45 | 45 | | Act takes effect September 1, 2025. |
