66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to the prosecution of the criminal offense of the
99 possession, manufacture, transport, repair, or sale of certain
1010 devices intended to modify handguns.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 46.05(a), Penal Code, is amended to read
1313 as follows:
1414 (a) A person commits an offense if the person intentionally
1515 or knowingly possesses, manufactures, transports, repairs, or
1616 sells:
1717 (1) any of the following items, unless the item is
1818 registered in the National Firearms Registration and Transfer
1919 Record maintained by the Bureau of Alcohol, Tobacco, Firearms and
2020 Explosives or otherwise not subject to that registration
2121 requirement or unless the item is classified as a curio or relic by
2222 the United States Department of Justice:
2323 (A) an explosive weapon;
2424 (B) a machine gun; [or]
2525 (C) a short-barrel firearm; or
2626 (D) a device designed and intended to make a
2727 handgun capable of automatically shooting more than one shot,
2828 without manual reloading, by a single function of the trigger;
2929 (2) armor-piercing ammunition;
3030 (3) a chemical dispensing device;
3131 (4) a zip gun;
3232 (5) a tire deflation device; or
3333 (6) an improvised explosive device.
3434 SECTION 2. The change in law made by this Act applies only
3535 to an offense committed on or after the effective date of this Act.
3636 An offense committed before the effective date of this Act is
3737 governed by the law in effect on the date the offense was committed,
3838 and the former law is continued in effect for that purpose. For
3939 purposes of this section, an offense was committed before the
4040 effective date of this Act if any element of the offense occurred
4141 before that date.
4242 SECTION 3. This Act takes effect September 1, 2025.
