88 AN ACT
99 relating to a grant program to provide free public school
1010 prekindergarten programs to certain children who are eligible for
1111 the subsidized child-care program administered by the Texas
1212 Workforce Commission.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subchapter E, Chapter 29, Education Code, is
1515 amended by adding Section 29.1535 to read as follows:
1616 Sec. 29.1535. PREKINDERGARTEN COMMUNITY-BASED CHILD-CARE
1717 PARTNERSHIP GRANT PROGRAM. (a) The commissioner shall establish
1818 and administer a grant program to support school districts and
1919 open-enrollment charter schools in increasing partnerships with
2020 community-based child-care providers to provide prekindergarten
2121 classes under Section 29.153.
2222 (b) A school district or open-enrollment charter school may
2323 apply for a grant under the program in partnership with a
2424 community-based child-care provider described by Section
2525 29.153(g).
2626 (c) A school district or open-enrollment charter school
2727 shall use money received under the grant program to fund the
2828 enrollment of eligible children in prekindergarten classes
2929 provided under Section 29.153 through a partnership between the
3030 district or school and a community-based child-care provider
3131 described by Section 29.153(g). A child is eligible for enrollment
3232 in a prekindergarten class described by this subsection using money
3333 received under the grant program if the child:
3434 (1) is at least three years of age; and
3535 (2) receives subsidized child-care services provided
3636 through the child-care services program administered by the Texas
3737 Workforce Commission.
3838 (d) The commissioner may provide grants under the grant
3939 program for the enrollment in each school year of not more than
4040 3,500 children in a prekindergarten class described by Subsection
4141 (c).
4242 (e) The agency shall annually report to the legislature
4343 regarding the number of children described by Subsection (c)
4444 enrolled in a prekindergarten class.
4545 SECTION 2. Section 29.1535, Education Code, as added by
4646 this Act, applies beginning with the 2025-2026 school year.
4747 SECTION 3. This Act takes effect immediately if it receives
4848 a vote of two-thirds of all the members elected to each house, as
4949 provided by Section 39, Article III, Texas Constitution. If this
5050 Act does not receive the vote necessary for immediate effect, this
5151 Act takes effect September 1, 2025.
