| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 263.002, Family Code, is amended by |
|---|
| 12 | 12 | | adding Subsection (c-1) to read as follows: |
|---|
| 13 | 13 | | (c-1) In making the required findings under Subsection (c), |
|---|
| 14 | 14 | | the court shall include the findings in a separate section of its |
|---|
| 15 | 15 | | order and enumerate with specificity the facts and the |
|---|
| 16 | 16 | | circumstances that serve as the basis for the court's findings. |
|---|
| 17 | 17 | | Merely citing the record of the proceedings or incorporating it by |
|---|
| 18 | 18 | | reference is insufficient to meet the requirements of this |
|---|
| 19 | 19 | | subsection. |
|---|
| 20 | 20 | | SECTION 2. Section 263.306, Family Code, is amended by |
|---|
| 21 | 21 | | adding Subsection (a-2) to read as follows: |
|---|
| 22 | 22 | | (a-2) If the court determines under Subsection (a-1)(6) |
|---|
| 23 | 23 | | that the child's parents are unwilling or unable to provide the |
|---|
| 24 | 24 | | child with a safe environment, the court shall include in a separate |
|---|
| 25 | 25 | | section of its order written findings describing with specificity |
|---|
| 26 | 26 | | the facts and the circumstances that serve as the basis for the |
|---|
| 27 | 27 | | court's determination that the child's parents are unwilling or |
|---|
| 28 | 28 | | unable to provide the child with a safe environment. Merely citing |
|---|
| 29 | 29 | | the record of the proceedings or incorporating it by reference is |
|---|
| 30 | 30 | | insufficient to meet the requirements of this subsection. |
|---|
| 31 | 31 | | SECTION 3. The changes in law made by this Act apply to an |
|---|
| 32 | 32 | | action that is pending on or filed on or after the effective date of |
|---|
| 33 | 33 | | this Act. |
|---|
| 34 | 34 | | SECTION 4. This Act takes effect September 1, 2025. |
