66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to procedures and required findings in certain suits
99 affecting the parent-child relationship.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 263.002, Family Code, is amended by
1212 adding Subsection (c-1) to read as follows:
1313 (c-1) In making the required findings under Subsection (c),
1414 the court shall include the findings in a separate section of its
1515 order and enumerate with specificity the facts and the
1616 circumstances that serve as the basis for the court's findings.
1717 Merely citing the record of the proceedings or incorporating it by
1818 reference is insufficient to meet the requirements of this
1919 subsection.
2020 SECTION 2. Section 263.306, Family Code, is amended by
2121 adding Subsection (a-2) to read as follows:
2222 (a-2) If the court determines under Subsection (a-1)(6)
2323 that the child's parents are unwilling or unable to provide the
2424 child with a safe environment, the court shall include in a separate
2525 section of its order written findings describing with specificity
2626 the facts and the circumstances that serve as the basis for the
2727 court's determination that the child's parents are unwilling or
2828 unable to provide the child with a safe environment. Merely citing
2929 the record of the proceedings or incorporating it by reference is
3030 insufficient to meet the requirements of this subsection.
3131 SECTION 3. The changes in law made by this Act apply to an
3232 action that is pending on or filed on or after the effective date of
3333 this Act.
3434 SECTION 4. This Act takes effect September 1, 2025.
